Jackson side has filed a motion asking judge to prevent AEG from mentioning the dismissal of the defendants as it could "confuse the jury" and they want a jury instruction that tells the jurors not to speculate why a person is no longer involved in the case.

Michael Jackson's mom must testify again, AEG lawyer says

Los Angeles (CNN) -- Michael Jackson's mother will be called back to testify by AEG Live as its last witness in their defense of Katherine Jackson's wrongful-death lawsuit on Monday, an AEG Live lawyer said Wednesday.

AEG Live lead attorney Marvin Putnam said he would question the 83-year-old Jackson family matriarch "about the absurdity of the damages" she wants the jury to award if they decide the concert promoter is liable in the pop icon's death.

A Jackson lawyer argued that AEG Live's "intent is to show the lawsuit's purpose is greed," while the judge suggested that any mother could be expected to say "there is no amount of money that would substitute for the loss of her son."

Putnam has frequently cited in interviews a "statement of damages" letter sent to him by a Jackson lawyer last year capping possible damages at $40 billion, but the judge ruled that he could not refer to it in court because it was not a sworn filing in the case.

Jackson lawyer Kevin Boyle pointed out that the lawsuit complaint only says that damages would be "according to proof at trial," based on testimony by several expert witnesses who have testified.

Katherine Jackson and grandchildren Prince, Paris and Blanket contend that AEG Live is liable in the singer's death because it negligently hired, retained or supervised Dr. Conrad Murray, who was convicted of involuntary manslaughter. AEG Live argues that Jackson chose and controlled Murray and that its executives had no way of knowing about the dangerous treatments he was giving him in his bedroom.

Jackson expert Arthur Erk -- a certified public accountant who has managed and audited the business affairs of many top artists -- testified that he was "reasonably certain" that Jackson would have earned at least $1.5 billion from touring, endorsements and sponsorships had he not died from a propofol overdose preparing for his comeback tour.

"It is very difficult to assess the value of the King of Pop," Jackson lawyer Deborah Chang told the judge Wednesday. "How do you even do that?"

The non-economic damages suffered because of Michael Jackson's death could be enormous considering "what happened to Paris Jackson," she said.

Jackson's 15-year-old daughter attempted suicide in June and remains in a treatment program.

The $40 billion estimate made last year was not a court filing but was a "best guess" before the expert reports were completed, Chang said.

Jackson lawyers seemed to welcome the prospect of AEG Live calling their client as their final witness, considering how jurors reacted when she was on the stand in July. Jurors leaned forward and paid close attention during her two days of testimony as the last witness in their case.

"Why are you here?" Jackson lawyer Brian Panish asked her.

"Because I want to know what really happened to my son," she said. "And that's why I am here."

Panish asked Jackson how it made her feel to be asked probing and personal questions about her family by AEG Live lawyer Marvin Putnam.

"It makes me feel real bad, because my son was a very good person," she said. "He loved everybody. He gave to charity. He was in the Guinness Book of World Records for giving to charity."

in July, she told jurors she filed the wrongful death lawsuit against AEG Live "because I want to know what really happened to my son."

If jurors decide that AEG Live is liable in Jackson's death, they could award damages based on the loss of the mother's and children's relationship with him and the amount of money he was unable to earn because his life was cut short.

After AEG Live rests its case -- which lawyers indicated would happen Monday -- the Jackson lawyers would have a chance to call several rebuttal witnesses. Closing arguments in the trial, which began in April, could be heard as soon as next week.

Exclusive: Randy Jackson called Michael Jackson’s executors “the three stooges” this past weekend in a podcast interview with his former attorney Brian Oxman. He named them, too– John Branca, John McClain, and Howard Weitzman (who is not an executor but the attorney who represents the estate).

Oxman was a lawyer once until he was disbarred after several disciplinary actions by the California Bar Association. After representing Randy Jackson in his divorce, Oxman also claimed for years to be the Jackson family attorney. He was fired from Michael Jackson’s defense team in 2005 during the child molestation trial in Santa Maria by Thomas Mesereau.

In the podcast, which I’ve linked below, Randy says: “My family is not happy with McClain and Branca. We don’t believe the will is real. We don’t support [the estate]. We’re not happy.”

Randy also says that “this is the tip of the iceberg” in relation to the Michael Jackson Estate’s current problems with the Internal Revenue Service. He says, “I know something is wrong.” Neither Randy nor any of his siblings received any money from Michael Jackson’s will. One brother, Jackie, is on the estate payroll, however. Randy says in the interview: “A few of my brothers and sisters I’m not getting along with right now.”

Last year, in June 2012, Randy was part of a trio with Janet and Jermaine Jackson who spirited their mother, Katherine Jackson, away to Arizona. The trip turned into a full scale scandal when Paris Jackson tweeted that no one knew what had happened to her grandmother. Randy refers to the incident as “the kidnapping” and suggests that someone–the executors?– invented that to take the heat off his now famous letter to the executors demanding that they resign.

Randy also suggests that “someone” was giving Dr. Conrad Murray orders to drug Michael.

How Brian Oxman got an internet radio show is another question altogether.

Katherine Jackson's lawyers want the fragmented, scrawled messages admitted under the hearsay exception for statements of future plans, intent or motive. A random collection of loose, handwritten notes penned by Michael Jackson and found in the mansion where he died have surfaced in a court filing and may give a window into the King Pop's psyche before he died.

"Weekly income 20 million a week. First multi billionaire entertainer, actor, director, 100 billion," reads one that might depict his personal aspirations.

"Better than Kelly & Astair," he wrote, likely referring to film legends Gene Kelly and Fred Astaire. "The greatest ever, in the likes of Chaplin, Michelangelo, Disney. These men demanded perfection, innovation always."

Another mentions Jackson's "last tour" and says ominously, "if I don't concentrate [on] film No Immortalization."

The fragmented, scrawled notes bear no dates, are riddled with misspellings, and give few clues as to whether the "Thriller" singer was brainstorming lists, writing reminders or simply recording things said by others.

Other compelling notes mention Dr. Conrad Murray, the physician now serving four years for recklessly giving Jackson nightly infusions of a surgery-strength anesthetic as a sleep aid and ultimately causing the superstar's fatal overdose.

Katherine's lawyers want to show and discuss the notes in closing statements to jurors.

AEG lawyers filed a motion this week saying they're "textbook hearsay" since there's no way to authenticate their meaning now that Michael is dead.

In yet another handwritten note, Michael Jackson mentions Cirque du Soleil — though he misspells it — as well as various money matters.



"There is simply no evidence showing when Michael Jackson wrote the notes, why he did so or what they mean," AEG lawyer Sabrina Strong wrote.

Michael's nephew Taj Jackson previously testified that he received the notes in a box handed to him by someone at Michael's rented mansion after the singer died.

Taj testified that he didn’t know how the box was filled and whether the individual documents originated in the rented estate or came from a prior storage facility, family records or another location altogether.

Katherine's lawyers want them admitted under the hearsay exception for statements of future plans, intent or motive.

Strong argued in the motion that the documents could represent notes taken during or after a business conversation as a record of something someone else said.

She also said they're irrelevant to the wrongful death suit.

"These notes and others seem to reflect unattainable hopes and dreams like world peace or becoming the richest man in the world," she wrote.

MICHAEL JACKSON’s purported secret diaries reveal his desperation to be “the greater ever” and his delusional bizarre secret fantasies about Walt Disney, Fred Astaire, Gene Kelly AND “The Seventh Voyage of Sinbad”!

The alleged diary is laced with a tortured Jackson’s yearning to make his comeback series of 50 concerts a success, after years of sordid headlines, questionable behavior and persistent child molestation allegations, RadarOnline reported.

“Better than Kelly and Astaire,” wrote Jackson. “The greatest [ever] in the likes of Chaplin, Michelangelo and Disney – these men demanded perfection, innovation always.”

Jackson also penned how he wanted AEG, the concert promoter, to help him develop and remake such fantasy film classics as The 7th Voyage of Sinbad, Ali Baba and 40 Thieves, Jack The Giant Killer and 20,000 Leagues Under the Sea.

Jackson — who considered himself a real-life Peter Pan – famed fantasy figure who never grew up accompanied by under-age gang of followers “The Lost Boys” — also plotted to create a live action 3D version of Aladdin, the Disney animation hit from 1992.

He reportedly scrawled, “If I don’t concentrate [on] film, no immortalization.”

Jacko also wanted to take conquer Broadway with a musical about his life and create his own merchandising.

Lawyers for Michael’s distraught mother Katherine Jackson, 83, are fighting to get the notes admitted into evidence; however AEG, who were promoting the London concerts, is arguing the notes are hearsay and should not be allowed to be used.

“There is simply no evidence showing when Michael Jackson wrote the notes, why he did so, or what they mean. As a result, there is no way to know whether the notes ever showed Michael Jackson’s plan, motive, or intent,” said the court motion.

Katherine, 83, is suing the concert promoter for wrongful death saying the company’s executives negligently hired the doctor who overdosed her son and should be held financially liable.

War ja klar, daß der Randy sich bei dem Oxman wieder zu den Nachlassverwaltern äußert, aber ist der wahhaft?
Jetzt haben die diese "Entführung" inszeniert? Na der hat sie doch wohl nicht mehr alle!
Wir waren doch alle Zeugen, was da abging, zumindest über Twitter und das war bestimmt nicht gefaket.
Natürlich mußte er sich auch zu den Schulden äußern. Der Randy und der Oxman wollten doch eh den Nachlass verwalten, da waren ja die Richtigen beieinander. Ein Schwätzer und ein Wahnsinniger, tolle Mischung!
Ich hoffe, daß der Branca & Co mal dem Randy eins überziehen, wenn er öffentlich solche Lügen verbreitet! Könnten sie doch, oder?

Aber wenn das wirklich zugelassen wird und die Jackson - Anwälte diese Zettel als Beweisgrund nehmen, dann müssen sie auch den Zettel berücksichtigen, wo sich der Michael seine Notizen zu "Conrad" macht!!!

genau, da ist man sprachlos, auf was für Ideen die Klägerseite so kommt ... hahaha, aber im Land, der unbegrenzten Möglichkeiten, ist ja insbesondere Schadensersatz vieles möglich ... denkt man nur an den heißen Kaffee, mit dem man sich verbrühen könnte, wenn man nicht darauf hingewiesen wurde ... :D :D

das werden doch nicht die einzigen "Zettelchen" sein, bestimmt gibt es noch viele Notizen von MJ ...
die präsentieren sie dann evtl. später noch als Buch ... :)

das wird ja dann mal wirklich interessant, wie die Jury sich entscheiden wird.
Ich bin immer noch der Überzeugung, daß dieser Prozess n i e hätte stattfinden dürfen.
Die Jacksons werden nur noch durch den Kakao gezogen, egal ob sie gewinnen oder verlieren.
Wem es so egal ist, daß die Privatsphäre eines Angehörigen in jeder Hinsicht durch den Kakao gezogen wird, hat es auch nicht anders verdient.

Hier noch ein Bild von Michael und Elton John, sie kannten sich wirklich gut, der Michael hat doch auch sein Studioalbum "Blood on the Dancefloor" dem Elton gewidmet. Steht, glaube ich hinten drauf.

Meine Vermutung, der Elton hat damals auch versucht, dem Michael zu helfen gegen seine Abhängigkeit.
Der Elton hat doch auch dem Eminem geholfen, von seiner Sucht loszukommen, also er hat ihn richtig aktiv unterstützt.

So, gestern wurde der letzte Zeuge für AEG, allerdings nur im Video, vernommen.
Jetzt kommen noch einmal Widerlegungen der Kläger-Seite, dann sicher Widerlegungen der Angeklagten, dann Statements von beiden Seiten, dann die Jury.
Es sieht fast so aus, als würde dieser Prozess in der nächsten Woche beendet werden.
Meiner Meinung nach war diese ganze Zeit vor Gericht nur eine Offenlegung von Michaels Privatsphäre, überflüssig wie ein Kropf und beschämend, so etwas überhaupt zuzulassen.
Was haben wir erfahren? Eigentlich nichts Neues, aber das im Detail.
Gleichzeitig habe ich festgestellt, daß man vor Gericht nicht die Wahrheit sagen muß. :D
Gilt für beide Seiten.
Die wichtigsten Zeugen in diesem Fall, nämlich der Murray und dieser Tohme, der nämlich diesen Deal mit AEG abgeschlossen hat und wahrscheinlich auch um den Todeszeitpunkt für Michael und AEG agierte, wurden gar nicht erst vor Gericht zitiert, von keiner Seite.
Deshalb ist das für mich kein Prozess gewesen sondern nur ein Spielchen, um zu versuchen auf Kosten von Michael, die Leute zu nerven oder zu unterhalten und für diesen Mist auch noch Geld zu verdienen.
