@FaIrIeFlOwEr

Revealed: Concert Promoter AEG Considering Call To DA Who Landed Conviction Against Michael Jackson’s Death Doc

Posted on Aug 1, 2013 @ 4:10AM | By Jen Heger

Lawyers for AEG are considering calling one of the district attorneys that successfully prosecuted Conrad Murray as possible witnesses in the wrongful death trial of Michael Jackson, RadarOnline.com is exclusively reporting.

Katherine Jackson is suing the concert promoter alleging that AEG failed to properly investigate and supervise Michael’s one-time doctor, Murray. Murray was convicted two years ago for the involuntary manslaughter death of the King of Pop.

The concert promoter “doesn’t want to put Conrad Murray on the stand for several reasons. First, Murray is a sanctimonious and arrogant, he will make the testimony all about him. He would likely be unwilling to answer the most important questions, and invoke the fifth amendment because he is appealing the conviction,” a source told Radar.

“Secondly, Murray would use the appearance to possibly promote a book/overseas tabloid interview he is planning upon his release from jail.”

The source added, “For those reasons, and more, AEG lawyer, Marvin Putnam, has been in contact with former Los Angeles County District Attorney, David Walgren, who is now a judge, and current prosecutor, Deborah Brazil, whom both handled Murray’s case.

“Both are agreeable to appearing and testifying. AEG needs to present a witness to the jury that can explain Murray’s role in Michael’s death. It’s AEG’s position that no one could have known that Murray was giving Michael a Propofol at night to sleep.”

The decision will be made “in the next several days about if one or both of them (Walgren/Brazil), will be called to testify,” the insider revealed.

“They would both be very compelling witnesses for AEG and the jury would be very impressed with their knowledge and professionalism of the criminal case.”

Testimony in the trial is expected to last until September.

Music video by Michael Jackson performing Behind The Mask.
(C) 2013 Optimum Productions.

Michael Jackson recorded a version of "Behind the Mask", with extra lyrics and an extra melody line, during the Thriller sessions after it was brought to his attention by producer Quincy Jones, but the track didn't make the album due to a royalties dispute with Yellow Magic Orchestra's management. A remixed version with overdubbed extra production by John McClain was eventually released on Jackson's 2010 posthumous album Michael. This version was also released as a single to radio and as a limited 7" for Record Store Day, plus a music video edited together from fan contributions was released under the title "The Behind the Mask Project". McClain's overdubs over the original 1983 tape include a newly-recorded saxophone solo and crowd noise from the 1992 Live in Bucharest: The Dangerous Tour TV special. No release of the original Thriller version has been announced yet.

actually that doctor was a jacksons expert I believe. so it's odd for him to say Michael would have died within days / weeks
^^

Michael Jackson estate denies allowing expert to help AEG Live

By Alan Duke, CNN
updated 10:14 PM EDT, Thu August 1, 2013

STORY HIGHLIGHTS

* AEG Live's consultant testifies Michael Jackson's estate waived its conflict of interest
* A Jackson estate lawyer contradicts testimony of consultant Eric Briggs
* The IRS is challenging Briggs' valuation of Jackson's share of huge music catalog
* Briggs calls assertions of Jackson's potential earnings "speculative"

Los Angeles (CNN) -- Michael Jackson's estate never gave an expert it hired permission to help AEG Live defend against the wrongful death lawsuit filed by Jackson's mother and children, the estate's top lawyer said Thursday.

The revelation raised questioned about the testimony of entertainment industry consultant Eric Briggs, who was hired by AEG Live to challenge the Jacksons' expert opinions concerning damages the concert promoter might owe if found liable in the singer's death.

Briggs told the court this week that his company -- FTI Consultants -- had gotten a waiver from a Jackson estate lawyer before agreeing to work on the concert promoter's defense.

Briggs had signed a confidentiality agreement with the Jackson estate in 2010 when he was hired to determine the value of its biggest asset -- the Sony-ATV music catalog that includes the Beatles songs -- for the estate's tax filings in 2010.

He was hired by AEG Live lawyers in February to prepare a challenge of the opinion of an expert hired by the Jackson lawyers to calculate how much money the singer would have earned had he not died while working on his comeback concerts in 2009.

Briggs said he -- or someone else in his company -- gained permission from the Jackson estate lawyer Jeryll Cohen to waive any potential conflict of interest.

"No one from the estate or any lawyers authorized or waived any potential conflict for FTI or Mr. Briggs," Jackson estate attorney Howard Weitzman wrote in an e-mail read in court Thursday.

Such a waiver would be counter to the interests of the estate's beneficiaries -- Jackson's mother and three children, a Jackson lawyer said.

Despite the conflict, the judge ordered Briggs to answer questions posed by Katherine Jackson's lawyers about the music catalog. He said although his valuation placed Jackson's interest in the catalog at about the same level as Jackson's debt at the time of his death -- which he said was $400 million -- the IRS challenged it as low.

An independent analyst hired by the IRS concluded he had undervalued Jackson's interest in the catalog by up to $300 million, Briggs testified.

Jackson lawyers argue it is evidence the singer was not broke when he died, contrary to what Briggs said in his testimony.

Briggs testified this week that it was his opinion that it was speculative that Jackson would have earned a dime more in his life if he had not died of a propofol overdose on June 25, 2009. He based his opinion the testimony of a doctor who said earlier that he did not think Jackson would have lived even another week past that date.

Panish, however, pointed out that the doctor's opinion was based on the assumption that Dr. Conrad Murray would still be giving Jackson nightly infusions of propofol -- the surgical anesthetic the coroner said killed him -- as a treatment for insomnia. The Jackson's suit contends AEG Live is liable because it negligently hired, retained or supervised Murray.

LOS ANGELES (KABC) -- Jurors heard from Michael Jackson's former security chief during the Jackson family's wrongful death trial on Thursday. They learned about a medical emergency involving the pop star that few people had known about.

About six years before Jackson stopped breathing in his Holmby Hills home, he fell unconscious at an Orlando hotel, according to his security director, Michael La Perruque.

La Perruque, a former Los Angeles sheriff's deputy, testified about an incident he says he has never disclosed publicly until now. He says hotel security alerted him that Jackson's children had called paramedics.

La Perruque said, "I found the two children crying. Prince and Paris, they were crying. They were saying they couldn't wake up daddy."

He told the jury that Jackson had collapsed on the floor but was still breathing. La Perruque said he helped Jackson get to bed, where he came to. AEG defense attorney Marvin Putnam asked if he later discussed the incident with Jackson.

La Perruque said no and that he didn't think it was his place to discuss it.

La Perruque worked for Jackson between 2001 and 2004, a time in which Jackson sought help from Dr. Alimorad Farshchian for addiction to Demerol and received an implant to inhibit the drug's effects.

La Perruque testified that he had concerns that Jackson may overdose and that 10 to 15 times he had observed Jackson slurring his speech, mumbling and nodding off in meetings.

Despite the episodes, La Perruque says he never saw meds in Jackson's hotel room or saw him take medications.

La Perruque described a failed intervention at Neverland Ranch in 2001. He said Jackson's brother Randy hired a helicopter to breach the perimeter and land on the grounds. He said that Jackson asked to have Randy sent away. La Perruque said he complied.

The AEG defense contends that the company should not be held liable for Jackson's death because AEG didn't know about medical conditions that Jackson kept secret and that Jackson insulated himself, even from his family.

The plaintiffs elicited testimony that the times Jackson was slurring his speech could have been from a sleeping pill because the star struggled with insomnia. La Perruque stated that there was no indication that the singer was taking any drugs in front of his children and that if he thought the children were endangered, he would have called authorities.

La Perruque will continue his testimony on Monday when the trial resumes.

Jermaine Jackson Thanks P-Square For Michael Jackson Tribute

By: Agency Report on August 2, 2013 - 2:30am

Michael Jackson’s elder brother Jermaine has confessed that he is thrilled with the new P-Square video for the song Personally, which was shot as a tribute to the late King of Pop. “It’s not every day that a phenomenal band comes along. P-Square are absolutely sensational with the showmanship, the singing, and the dancing,” Jermaine said in a video clip posted on P-Square’s official YouTube channel.

“It really knocked me out, because it kind of reminded me of me and the Jackson 5 brothers when we first started. I want to thank P-Square for doing an incredible tribute to my brother Michael.” The video which was shot in Lagos, and co-directed by Jude Engees Okoye and Clarence Peters, is another video which showcases the dexterity of the Okoye brothers.

The video also brings back the memory of Peter and Paul Okoye as members of two now defunct groups who mimed and choreographed the late Pop singer’s dance routines – Smooth Criminals and MMPP in Jos, Plateau State.

The Jacksons vs. AEG Live — Zeugen von AEG, 4. Teil

1. August 2013

The Jacksons vs. AEG Live — Zeugen von AEG, 5. Teil

1. August 2013

Jackson's security chief details drug concerns

Posted Thursday, Aug. 01, 2013
By ANTHONY McCARTNEY
AP Entertainment Writer

LOS ANGELES — A former security worker for Michael Jackson told a jury Thursday that he was concerned the singer would overdose on prescription medications in the early 2000s but didn't see signs of impairment in the singer later that decade.

Michael La Perruque said he occasionally went into the singer's hotel room to make sure he was breathing and would often find doctors to treat the pop superstar when he traveled. La Perruque retired from his job as a sheriff's deputy in 2001 to work as the head of Jackson's security detail and frequently traveled with him until 2004.

La Perruque said the singer's children called 911 during a trip to Florida in 2001 or 2002 after their father collapsed in a hallway in a hotel suite at Walt Disney World. He said he found Jackson unconscious, revived him before paramedics arrived and never saw any signs of drugs or alcohol that the singer may have taken.

Paramedics checked out the singer and determined he didn't need further medical attention, La Perruque said.

Deborah Chang, an attorney for Jackson's mother said there was no evidence that the incident was drug-related.

He told jurors that his testimony Thursday was only the second time he had told the story. The first came in a deposition with lawyers for AEG Live LLC, which is being sued by Jackson's mother claiming the company negligently hired the doctor convicted of giving her son a fatal overdose of the anesthetic propofol.

AEG denies it is responsible for the singer's death.

La Perruque stopped working for Jackson in 2004, but returned to oversee his security in late 2007. He said he didn't see any signs that Jackson was impaired during the few months he worked for him again.

He testified he last saw Jackson two weeks before the singer's death and he looked fine, but he noticed that his former boss was skinnier than usual.

La Perruque said he spoke to two of Jackson's doctors about his concerns about the singer's prescription drug use, but that he never spoke directly about it to the singer because he didn't want him to become defensive.

"It was my concern that he may overdose," he said.

He said he knew Jackson had severe back pain and difficulty sleeping. Despite seeing the entertainer impaired, La Perruque said he never saw Jackson take any drugs or saw any signs of medications lying around.

Jackson did try to get help, he said. "He fought very hard to be sober," La Perruque said. "He fought very hard not to be dependent on these prescription medications."

Jackson however kept members of his family away because he knew they were trying to stage an intervention, he said.

He told jurors that Jackson's younger brother Randy arrived at Neverland Ranch one day in a helicopter to speak with his brother about his medication usage. La Perruque said he turned him away.

He said Jackson called him in the middle of the night between 20 and 30 times in the early 2000s and was often mumbling and incoherent. Half those times La Perruque said he went to the singer's room to check on him, and they would start talking.

"I think he was just lonely," La Perruque said. "He wanted somebody to talk to."

Michael Jackson - Michael Jackson Collapsed At Disney World

by WENN | 02 August 2013

Michael Jackson's young children had to call 911 after their father collapsed during a trip to Disney World in Florida, according to the singer's former security chief.

Michael La Perruque, who worked as the Thriller hitmaker's head of security, made the revelation when he took the stand at a court in Los Angeles on Thursday (01Aug13) as part of the Jackson family's legal battle with concert promotion company Aeg Live.

La Perruque, who worked for the star between 2001 and 2004, reveals the incident took place at a Walt Disney World hotel in Orlando, Florida during a Jackson family outing to the resort in the early 2000s, and he claims the singer's two eldest kids, Prince and Paris, called for emergency services after their father passed out.

The former Los Angeles sheriff's deputy insists the children were distraught when they couldn't rouse their father in a scene which eerily echoes Jackson's death at his home in California in 2009.

La Perruque told the court, "I immediately grabbed Mr. Jackson's key and went across and opened the door, where I found the two children, Prince and Paris, saying they couldn't wake up daddy. I found Mr. Jackson in the hallway laying prone and unconscious. I turned him over. Ultimately he was breathing so I kept shaking him and waking him up and then I was able to get him up and escort him back to his bedroom and put him in bed."

He also insisted his testimony was the first time he had spoken about the incident in public.

Jackson died in 2009 after suffering a cardiac arrest at his home. Prince and Paris both witnessed attempts to revive their father, who was subsequently found to have died of an overdose of anaesthetic.

Jackson's mother Katherine has filed a wrongful death lawsuit against Aeg bosses, alleging they should assume liability for his death as they hired Conrad Murray, the doctor who was jailed for giving the singer the fatal drug overdose.

La Perruque will return to the stand to continue his testimony on Monday (05Aug13) when the trial resumes.

The Jacksons vs. AEG Live — Zeugen von AEG, 6. Teil

2. August 2013

Estate Denies Allowing Expert To Help

howard-weitzman

CNN has reported that Michael’s Estate, never gave trial witness Eric Briggs, an expert they hired previously, permission to help AEG Live defend the wrongful lawsuit filed by Mrs Jackson.

This revelation has raised questions about the testimony given by Eric Briggs, an entertainment industry consultant, who was hired by AEG Live. He had signed a confidentiality agreement with the Estate in 2010 when he was hired to value the Sony-ATV music catalog, for tax purposes.

Briggs told the court this week that, FTI Consultants, which is his company, had a waiver from a Michael Estate lawyer before agreeing to work for AEG.

He was hired by AEG in February to calculate how much money Michael would have earned if he had not died.

Howard Weitzman wrote an email which was read in court Thursday saying; “No one from the estate or any lawyers authorised or waived any potential conflict for FTI or Mr Briggs.”

The judge ordered Briggs to answer questions put forward by Mrs Jackson’s lawyers, despite the conflict. He said a Michael’s interest in the catalog was about the same level as his debt at the time of his death, around $400 million.

The IRS have said this is low and an independent analyst which they have hired concluded he had undervalued Michael’s interest in the catalog by up to $300 million.

Secrets of the Michael Jackson Trial

Drugs, ghosts, violence and much more, as testimony rolls into its fourth month

By Steve Knopper
August 2, 2013 2:00 PM ET

The Jackson family's lawsuit against AEG Live, the promoter that planned Michael Jackson's London comeback concerts at the O2 Arena in London, is serious business. Michael's mother, Katherine, seeks billions of dollars in damages, arguing that AEG negligently hired Dr. Conrad Murray, who was convicted of giving the insomniac Jackson a drug combination including the anesthetic propofol, which caused him to die in his sleep. AEG denies responsibility. The months-long trial has been full of strange details – here are the strangest.

His promoter was a bully
To motivate a recalcitrant Jackson before the London press conference announcing the This Is It shows, AEG Live CEO Randy Phillips (according to an e-mail he sent a colleague), "slapped him and screamed at him." Phillips testified that he was acting like a coach: "I slapped him on the butt."

His kids' nanny was really weird
According to Paris Jackson's testimony, Grace Rwaramba, former nanny to Jackson's kids, would call hotels, tell staff she was his wife and be admitted to his room, where she would slip into the star's bed. "She was obsessed with him," Paris said.

He probably went longer without REM sleep than any human ever
A Harvard Medical School sleep expert, Dr. Charles Czeisler (who has also worked with the CIA and the Rolling Stones), testified that the 60 straight nights Jackson spent on propofol resulted in a "constellation of symptoms" including paranoia, erratic behavior and severe weight loss.

Violence and threats were common in Jackson's world
Jackson's makeup artist Karen Faye testified that once, before a concert in 1993, the singer became ill and she encouraged him to bail on the show. She claims that a doctor provided by the tour's insurance company choked her until she couldn't breathe and said, "You don't know what you're up against."

He really did have a rodent for a childhood friend
Echoing his song "Ben," Katherine testified that, as a boy, Michael once smuggled a mouse into a Beverly Hills restaurant in his coat pocket.

According to Lionel Richie's ex, his ghost has no problem with Dr. Murray
While on the stand, AEG Live's Phillips recalled a conversation he had with Lionel Richie's ex-wife Brenda. Jackson's ghost, Phillips testified, told her the superstar had "accidentally killed himself" and absolved Murray of responsibility. A Jackson family attorney objected, but the judge let the testimony stand.

Who is Debbie Rowe?

* Michael Jackson's ex-wife is set to testify in his wrongful death trial
* Rowe, who is the mother of two of Jackson's children, primarily stays out of the spotlight

debbie rowe

Debbie Rowe, Michael Jackson's ex-wife and the mother of two of his children, is set to testify at the wrongful death trial that his family has brought against entertainment giant AEG Live.

The suit claims that the concert promoter is liable for the death of Jackson because it hired Dr. Conrad Murray. Murray was convicted of involuntary manslaughter for Jackson's death in 2011.

AEG Live will call Rowe to testify because of her close relationship with Jackson. So the mother of Jackson's two oldest children, who has primarily stayed out of the spotlight -- both before and since Jackson's death -- will now be thrust into the center of the explosive trial.

Jackson and Rowe met while she was working as a dermatology nurse for Dr. Arnold Klein. Klein had been Jackson's personal friend and dermatologist for years. Jackson visited the doctor frequently after he was diagnosed with vitiligo in the 1980s.

Rowe has said in interviews that her friendship with Jackson grew over the course of these visits, and that Jackson expressed a deep desire to become a father. Rowe says she desperately wanted to give him that gift, and they struck an agreement that she would bear his children.

It was while she was pregnant with their first child, Prince, that they wed in Australia in 1996. A year later, Rowe gave birth to their second child, a daughter named Paris. Rowe has said that Jackson was overjoyed by fatherhood and took full responsibility for raising the children.

The marriage did not last, however. The couple divorced in 1999 after three years of marriage, and Rowe went on to relinquish custodial rights over the two children. In 2004, however, Rowe tried to reverse that decision when the singer faced child abuse charges. Though she did not win custody, Jackson was ordered to pay her $60,000 in legal fees.

Then in 2005, during Jackson's highly publicized molestation trial, Rowe came to her ex-husband's defense and claimed in court that he was a supportive and loving father, though she admitted she had not seen Jackson or her children for several years. The pop star would eventually be acquitted on all counts.

Shortly after the trial, Rowe moved to a ranch in Palmdale, California, and continued to live a life out of the spotlight until Jackson's death in 2009. Since Jackson’s passing, Rowe has reportedly become a permanent fixture in her children's lives and has grown close to daughter Paris -- particularly after the 15-year-old's failed suicide attempt June 5.

David Berman Questions Choice Of Doctor

david-berman

The promoter of Michael’s ‘This Is It’ series of concerts said a conflict of interest was created with his physician, when the terms were negotiated for the doctor’s deal.

David Berman told jurors that the company should not have negotiated Murray’s contract, without notifying Michael’s representatives of the discussion.

The former head of Capitol Records and high-level positions at several other record companies is being paid to testify for Katherine Jackson in her lawsuit against the concert company. Asked whether it was appropriate for AEG Live to attempt to hire a doctor on Michael’s behalf, Berman responded; “I believe that it’s highly inappropriate. It is highly unusual.” He said a more appropriate relationship would have been for Michael to hire cardiologist Conrad Murray without any involvement from AEG Live.

Based on draft contracts and emails between company executives, Berman also said he believed AEG Live thought it controlled the physician and that he had never heard of a situation in which a tour promoter hired a doctor on behalf of an artist.

Berman began working in the music business in 1969 as a transactional attorney before making the leap to record executive. He believed that music companies owe a higher obligation to artists than to music buyers or concert goers and, in this instance he said AEG failed Michael Jackson.

He was shown emails in which a tour accountant traded emails with Murray without including any of the Michael’s representatives.

To prepare for his testimony, Berman said he had reviewed numerous documents, including twenty-six depositions and testimony from AEG executives during the trial and he is being $500 an hour for his work on the case.

The company’s lawyers have yet to question Berman but already have objected to his expertise. An AEG Live defense attorney has noted that Berman was never a tour producer or promoter, functions that AEG Live was serving as during preparations for Michael’s ‘This Is It’ shows.

Superior Court Judge Yvette Palazuelos reminded jurors that they will ultimately decide whether AEG Live hired Murray.

Michael La Peruque, a former security worker for Michael told the jury Thursday that he was concerned that Michael would overdose on prescription medications in the early 2000s but didn’t see signs of impairment in him later that decade. He said he occasionally went into Michael’s hotel room to make sure he was breathing and would often find doctors to treat him when he travelled.

La Perruque retired from his job as a sheriff’s deputy in 2001 to work as the head of Michael’s security and frequently travelled with him until 2004.

La Perruque said Michael’s children called 911 during a trip to Florida in 2001 or 2002 after their father collapsed in a hallway in a hotel suite at Walt Disney World. He said he found Michael unconscious, revived him before paramedics arrived and never saw any signs of drugs or alcohol that the singer may have taken. Paramedics checked Michael out and determined he didn’t need further medical attention, La Perruque said.

He told jurors that his testimony, was only the second time he had told the story. The first came in a deposition with lawyers for AEG Live.

La Perruque stopped working for Michael in 2004, but returned to oversee his security in late 2007. He said he didn’t see any signs that Michael was impaired during the few months he worked for him again. He also testified that he last saw Michael two weeks before his death and he looked fine, but he noticed that his former boss was thinner than usual.

La Perruque said he spoke to two of Michael’s doctors about his concerns regarding prescription drug use, but added that he never spoke directly about it to Michael because he didn’t want him to become defensive. “It was my concern that he may overdose,” he said.

He added that said he knew Michael had severe back pain and difficulty sleeping.

Despite seeing Michael impaired, La Perruque said he never saw him take any drugs or saw any signs of medications lying around.

“Michael did try to get help,” he said. “He fought very hard to be sober. He fought very hard not to be dependent on these prescription medications.”

He continued by saying that Michael kept members of his family away because he knew they were trying to stage an intervention. He told jurors that Randy arrived at Neverland Ranch one day in a helicopter to speak with his brother about his medication usage. La Perruque said he turned him away.

He also said that Michael called him in the middle of the night between twenty and thirty times in the early 2000s and was often mumbling and incoherent. Half those times La Perruque said he went to his room to check on him and they would start talking.

“I think he was just lonely,” La Perruque said. “He wanted somebody to talk to.”

Michael Jackson's survivors vs. AEG: a gold mine for witnesses

Wrongful-death suit means lots of expert medical and business testimony. And that means each side pays big bucks to those who take the stand.

By Jeff Gottlieb
August 3, 2013, 7:48 p.m.

399

A lot of people are making a lot of money off the Michael Jackson wrongful-death case — and then there are the lawyers.

Witnesses in the case are being paid huge sums to analyze the pop star's earning power, his health, his popularity, even his inability to get a good night's sleep.

Attorneys representing concert promoter AEG Live on the one side and Jackson's mother and his three children on the other have so far spent around $1 million just on experts who have testified about how much money the singer could have earned had he not died in 2009 from an overdose of the anesthetic propofol.

That doesn't include physicians who are also being paid as expert witnesses. One of them, Dr. Charles Czeisler, a Harvard University sleep expert, testified how propofol may have affected Jackson. He was paid $950 an hour.

"For $950 an hour, can you please keep your answers short?" said attorney Michael Koskoff, drawing laughter from jurors.

The stakes in the lawsuit, in its third month and counting, are enormous — at least in terms of dollars. Each side is bringing in highly paid experts to convince jurors of their case, sometimes leading to dueling witnesses.

Certified public accountant Arthur Erk, testifying for the Jacksons, calculated that the singer could have made $1.5 billion if his doomed "This Is It" concert series in London had blossomed into a world tour, and an additional $500 million from subsequent tours, endorsements and merchandise sales.

Erk told jurors that he was being paid $475 an hour and that his firm had so far billed $332,500. The clock was ticking as he sat on the witness stand, telling the jury how much he was making.

AEG's expert was Eric Briggs, a senior managing director at FTI Consulting in Century City. He said it was speculative to think Jackson would earn anything at all because of his drug use, erratic behavior and track record of canceling shows. The notion that he could even pull off such an ambitious tour was doubtful, he said.

Briggs testified that he was costing AEG $800 an hour and that he had already spent about 350 hours on the case. He said his team put in 500 to 600 hours and that they had billed AEG between $600,000 and $700,000.

From the beating he took on the stand from Jackson attorney Brian Panish, he might not have thought that was enough.

One of the consultants who worked with him, Briggs testified, was a year out of college. Briggs said he had done "general research," such as finding out the capacities of arenas where Erk said Jackson might perform during his world tour.

The recently graduated consultant charged $350 an hour.

So whom are the 12 jurors to believe?

USC law professor Jody Armour said people tend to think of experts as neutral observers reciting facts.

"But these experts are actually trying to persuade the jury that their version is the version they should buy," he said. "It's an odd role these scientific experts are thrown into."

The Jacksons have sued AEG Live and two of its executives, alleging that the entertainment company negligently hired and controlled Dr. Conrad Murray, who administered the fatal dose of propofol to Jackson. AEG says the singer hired Murray and that any money the company was supposed to pay the doctor was part of an advance to Jackson.

When the dollar stakes are far lower, plaintiffs' attorneys, who usually foot the bill for experts, must think twice before taking a case. The amount they can collect — even if they win — might make it not worth their time, lawyers said.

Expert testimony can backfire. The Jacksons' attorneys liked the deposition of AEG expert Dr. Paul Early so much that they played portions of it during the trial. Early testified that addicts shouldn't be blamed for their problem.

AEG has not called him to the witness stand.

The fees that witnesses charge can vary greatly. Gordon Matheson, head of Stanford University's sports medicine program, testified as an expert for the first time. His fee was $500 an hour. Matheson testified that Murray had conflicts of interest that would probably lead to poor medical decisions.

Dr. Daniel Wohlgelernter, a cardiologist who testified for the Jacksons, said he receives about 20% of his income as an expert witness. He said he had testified in 31 trials and been retained as an expert in 400 cases. He was paid $4,250 for half a day of testimony and $450 an hour to prepare.

Czeisler, the Harvard sleep expert, testified for the Jacksons for several days. AEG's attorneys argued that though he may be a world-renowned sleep expert, he wasn't an expert on propofol.

That forced the Jacksons' attorneys to call anesthesiologist Emery Brown, who holds endowed chairs at Harvard and MIT and is considered one of the world's experts on the anesthetic.

Brown, who testified in a video deposition, said he was being paid $1,000 an hour but that he was donating his $75,000 fee to Massachusetts General Hospital.

Jurors, Armour said, often suspect that one side or the other is buying an expert to provide the testimony it wants. Brown's contribution, Armour said, boosts his credibility to the jury.

"He's donating it all to charity, ladies and gentlemen of the jury, so this is coming from the heart," Armour said. "It's a bowl-you-over rhetorical move to make."
