Court documents filed by prosecutors say that Jackson's kids -- Prince Michael, Paris and Blanket -- are "entitled to wages or profits lost due to injury incurred by the victim," adding that prosecutors estimated Jackson would have made $100 million in revenue from his This is It tour.

"The defendant has displayed a complete lack of remorse for causing Michael Jackson's death," according to the court papers filed by Deputy District Attorneys David Walgren and Deborah Brazil.

"... Due to the actions and decisions of the defendant alone, justice requires the defendant be sentenced to state prison for four years, be ordered to pay appropriate restitution to Michael Jackson's children and be ordered to pay all requisite fines under the law," the prosecutors argue in the court papers.

Murray, 58, was convicted on November 7 over Jackson's death, from an overdose of the powerful anaesthetic propofol, on June 25, 2009. He is scheduled to be sentenced Tuesday by Los Angeles Superior Court Judge Michael Pastor.

Attorneys for Murray, however, contend in court papers that the doctor's "background and character" warrant a sentence of probation, not prison time.

"Many of his patients are elderly, and many reside in low-income, underserved communities," according to the court papers filed by defence attorneys Edward Chernoff, J. Michael Flanagan and Nareg Gourjian.

"Dr Murray has a long history of treating everyone who came to his clinic, whether or not they had insurance coverage or the funds to pay him."

During his trial, Murray admitted to having given Jackson a small amount of propofol to help him sleep, but not the massive amount of the drug found in his body on the day he died.

LOS ANGELES — Prosecutors who depicted Michael Jackson’s doctor as remorseless for the superstar’s death urged a judge Wednesday to sentence him to four years in prison, while a defense lawyer said Dr. Conrad Murray is in a prison of self-punishment and should receive probation.

The opposing sentencing memos were filed in advance of Dr. Conrad Murray’s sentencing hearing Tuesday. He has been in jail since he was convicted Nov. 7 of involuntary manslaughter for Jackson’s fatal overdose of the anesthetic propofol.

Prosecutors David Walgren and Deborah Brazil wrote that Murray has shown no remorse for Jackson’s death and has placed blame on others, including Jackson himself. They cited a series of post-trial media interviews with Murray that they submitted to Superior Court Judge Michael Pastor on a DVD.

In one excerpt, Murray states, “I don’t feel guilty because I did not do anything wrong.”

“Finally, the defendant consistently blames the victim for his own death,” said the prosecution brief, “even going so far as to characterize himself as being ‘entrapped’ by the victim and as someone who suffered a ‘betrayal’ at the hands of the victim.”

Defense attorney Nareg Gourjian, citing letters of praise from Murray’s former patients, said: “There is no question that the death of his patient, Mr. Jackson, was unintentional and an enormous tragedy for everyone affected. Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pall of sadness since the loss of his patient, Mr. Jackson.”

Gourjian said Murray will never stop punishing himself over Jackson’s loss and, “In effect, he will be serving a form of life sentence. However, the offense was not willful nor intended. ... He is, by every account, immensely sorrowful and remorseful.”

Murray was convicted after six weeks of testimony focusing on Murray’s administration of the drug propofol, an anesthetic not intended for treatment of insomnia or for home use. While Jackson was under the influence of the drug, Murray admitted leaving the room, prosecutors noted. They said he abandoned his patient when he was the most vulnerable.

In their memo, prosecutors said Murray “acted as an employee and as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship.”

Gourjian asked the judge to consider Murray’s humble beginnings in Trinidad and his lengthy career of doing good during his practice in Houston.

“The transgression for which he is to be judged should be viewed within the context of the larger life of which it is a part,” he said.

He also argued in his 45-page memo that current budgetary problems and overcrowding of prisons has made it necessary to release non-violent, non-dangerous offenders. “Dr. Murray is clearly such a defendant,” he said.

Gourjian noted that because of constant death threats [anm. ähhh, wie jetzt?... erst selbstmordgedanken, jetzt plötzlich morddrohungen????], Murray must be kept in solitary confinement, which is expensive.

“Conrad Murray still has the knowledge, capacity and motivation to be a source of healing in the world,” Gourjian wrote. “Though he will perhaps not again be a doctor ... he could educate and counsel patients about heart care and disease prevention.” He suggested that as a form of community service by the doctor.

Prosecutors attached to their motion a statement of monetary losses because of Jackson’s death exceeding $100 million. They suggested that “appropriate restitution” from Murray be ordered for Jackson’s children.

Murray, 58, was convicted Nov. 7 in Michael Jackson's June 25, 2009, overdose death from the anesthetic propofol.

Murray is scheduled to be sentenced Tuesday and could face up to four years in prison.

Defense attorneys cited the increased cost to the state in incarcerating Murray in protective custody. They also cite Murray's humble background and state he is not a dangerous person.

In court papers, defense attorneys asked for consideration of the "sum total of the contributions" made by Murray, and for a "sentence of probation with substantial community service as a means of repaying his debt to society."

Court papers show the pprosecution has recommended "the defendant be sentenced to state prison for 4 years, be ordered to pay appropriate restitution to Michael Jackson's children, and be ordered to pay all requisite fines under the law."

The prosecution estimates restitution, including Jackson's projected earnings from the 50-concert "This Is It" tour and associated funeral expenses, totals nearly $102 million.

wenn den schadensersatzforderungen von Walgren/Brazil auch nur ansatzweise stattgegeben wird, dürfte gewährleistet sein, dass Murray in keiner weise und zu keiner zeit profit aus seinem handeln erwirken kann.... und alleine DAS gibt dieser, in anbetracht von Murray's finanzlage zugegebenermaßen unrealistische forderung einen sinn....

und man kann nur hoffen, dass eine schadensersatzzahlung - in welcher höhe auch immer - DIREKT in den Children's Trust und NICHT in den Family Trust geht.... warum, das brauche ich wohl nicht näher zu erläutern ;).....

nicht übersehen sollte man auch Walgren's/Brazil's forderung, Murray in einem staatsgefängnis und NICHT in einem bezirksgefängnis inhaftieren zu lassen.... in einem staatsgefängnis bestehen kaum bis gar keine chancen auf hausarrest und/oder halbierung der haftzeit ;)....

ich suche schon permanent nach dem 45-seitigen memo der verteidung im original, aber bisher ist davon nichts zu finden ;).... kann sich aber sicher nur um minuten, höchstens wenige stunden handeln, bis auch das von irgendwelchen "insider-quellen" ins www gestellt wird :).....

The lawyers of Conrad Murray, who is in jail for involuntary manslaughter in the death of Michael Jackson, have urged a Los Angeles judge to avoid sentencing the doctor to more time in prison, where they say he has been receiving death threats.

The prosecution team, led by David Walgren, want Murray to receive the maximum sentence of four years in prison and pay the singer's three children, Prince, Paris and Blanket, restitution costs that could total more than $100 million.

The 58-year-old Grenada-born cardiologist has been behind bars since he was convicted on November 7. Murray is due to be sentenced on November 29. (you can watch Conrad Murray's sentencing live here - at 8:30 a.m.) In addition to more prison time, he could also lose his medical license.

His attorneys filed a sentencing memorandum on Wednesday, November 23, just before the Thanksgiving holiday, urging the judge to give him "a sentence of probation with substantial community service as a means of repaying his debt to society."

"The court is urged to refrain from imposing further time in custody," it said. "Because he must be maintained in solitary confinement at all times out of concern for his safety due to the death threats received, the conditions of his confinement are not only very onerous to him personally, but are extremely costly and cumbersome to the jail."

"Were he a dangerous person, this would be viewed as a necessary expense, but he is not," it added. "The offense was not willful or intended. It was, in fact, the last thing in the world that Dr. Murray would ever want to happen to one of his patients. He is, by every account, immense sorrowful and remorseful."

Head defense lawyer Ed Chernoff had made a similar argument at the time of Murray's conviction but the judge agreed with Walgren's stance that the doctor should be taken into custody and denied bail.

However, recently-issued California regulations state that if Murray is given a jail sentence, he would serve his time at a county facilty rather than in state prison because involuntary manslaughter is not considered a violent offense. Also, the duration of a jail sentence would be cut in half.

Walgren and his fellow prosecutors stated in their own memorandum, also submitted on Wednesday, that Murray should be sent to "state prison for four years, be ordered to pay appropriate restitution to Michael Jackson's children and be ordered to pay all requisite fines under the law."

The prosecution team says Jackson was set to earn $100 million for his sold-out "This Is It" London concert series that he had prepared for before his 2009 death.

It also says the singer's funeral, memorial services and other associated expenditures cost more than $1.8 million. Murray should also be ordered to pay attorney fees, collection costs and any interest, at a rate of 10 percent, that accured since Jackson died.

CONRAD MURRAY CAN STILL BE 'SOURCE OF HEALING IN THE WORLD'

In their request, Murray's lawyers also cited the doctor's troubled upbringing and said he could still practice medicine in some way.

"Conrad Murray is a self-made man of humble origins," the defense attorney's sentencing memorandum reads. "He grew up in a Third World environment where most basic services, including health care, were beyond reach for his family. He walked to school barefoot his first two years. He did not live with his mother until he was 7 years old, and did not meet his natural father until he was 25."

"Yet from a very early age, he knew that he wanted to be a doctor," it adds. "Conrad Murray still has the knowledge, capacity and motivation to be a source of healing in the world. Through he will perhaps not again be a doctor qualified to make diagnoses, he could educate and counsel patients about heart care and disease prevention."

Despite recent reports, Murray has not said he wants to commit suicide while in jail, one his lawyers told OnTheRedCarpet.com earlier this month. A source close to the doctor had said beforehand that Murray was never placed on suicide watch, but was "devastated" and "shocked he's actually in jail."

A Los Angeles jury had deliberated the fate of Murray, who had treated Jackson at his home on the day he died, for a total of about eight and a half hours after a six-week trial. In his closing argument, Walgren remarked sarcastically, "Poor Conrad Murray," in an apparent mockery of the way the doctor's lawyers tried to portray him to the jury.

After the unanimous guilty verdict was read, Murray appeared stone-faced and a single squeal was heard inside the courtroom (watch video).

Another one of the doctor's lawyers, Michael Flanaghan, told OnTheRedCarpet.com's parent company, KABC Television after the verdict was read: "Well, certainly there'll be an appeal. I'm sympathetic for (the Jackson's family's) loss, a tremendous loss."

Autopsy results show that Jackson died at age 50 on June 25, 2009 from an overdose of propofol, a powerful anesthetic that the singer referred to as his "milk," and other sedatives. Murray had administered the drugs to Jackson in the hours before his death. The King of Pop had suffered a cardiac arrest at his rented Los Angeles home and was pronounced dead at a hospital.

The jurors are made up of seven men and five women (check out more details about them). One of them, Debbie Franklin, told ABC's "Good Morning America" that she and the other jurors believe Jackson would "absolutely" be alive today if not for Murray.

The prosecutor in the Conrad Murray manslaughter case will ask Judge Michael Pastor to sentence the doctor to the maximum -- 4 years in State Prison ... TMZ has learned.

The D.A. just filed legal docs with the judge for the sentencing on Tuesday.

As we have already told you ... even if Murray gets 4 years, he will not spend a single day in prison because of a new California law. He will go to L.A. County Jail, where a 4-year sentence would be whittled down to 2 years. And, on top of that, Murray would be eligible for house arrest.

As we already reported ... Murray's lawyers will ask the judge to place him on probation.

Los Angeles (RPO). Die Staatsanwaltschaft hat für den wegen fahrlässiger Tötung schuldig gesprochenen früheren Leibarzt des verstorbenen Sängers Michael Jackson vier Jahre Haft gefordert. Die Anhörung zum Strafmaß ist für kommenden Dienstag angesetzt.

Ein Anwalt von Conrad Murray erklärte hingegen vor Gericht in Los Angeles, dieser befinde sich in einem Gefängnis der Selbstbestrafung, weshalb eine Bewährungsstrafe ausreichend sei.

Für kommenden Dienstag ist eine Anhörung zum Strafmaß für Murray vorgesehen. Er wurde am 7. November schuldig gesprochen, Jackson eine tödliche Überdosis des Betäubungsmittels Propofol verabreicht zu haben. Seitdem sitzt er im Gefängnis.

(Reuters) - Prosecutors on Wednesday asked a judge to sentence Michael Jackson's former doctor to the maximum four years in prison for his involuntary manslaughter conviction in the singer's 2009 death.


In a separate court filing, defense attorneys for Dr. Conrad Murray, 58, sought to convince Los Angeles trial judge Michael Pastor to sentence their client to probation.

The dueling legal papers come in advance of a hearing on Tuesday at which Pastor will issue his sentence for Murray, who is currently in jail awaiting that court date.

Jackson was found lifeless at his mansion on June 25, 2009, about three weeks before he was due to begin a series of comeback concerts in London.

Murray was at the singer's house and had given him the powerful anesthetic propofol as a sleep aid, which medical examiners said was the chief cause of his death.

Doctors testified at the trial that propofol, which is often used for surgery, should never be given in a home setting without adequate staffing and equipment.

In seeking to justify their request for a maximum prison sentence of four years for Murray, prosecutors David Walgren and Deborah Brazil argued that the doctor took advantage of Jackson's trust in him, all while being under salary for $150,000 a month.

"Instead of utilizing his medical knowledge and training to provide Mr. Jackson with proper medical care, the defendant acted as an employee and as a drug dealer and completely corrupted the trust necessary in a proper doctor-patient relationship," prosecutors stated.

Defense attorneys said in their court papers that Murray's "background and character" warrant a sentence of probation, not prison time. They also cited his history of treating poor patients regardless of their ability to pay.

"Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pail of sadness since the loss of his patient, Mr. Jackson," defense lawyers stated.

Legal experts have said that, because of overcrowding in California prisons, Murray may spend as little as a few months behind bars regardless of what he receives as a sentence.

California adopted a new law in October that sends low-risk prison inmates to county jails, and in turn officials who run Los Angeles county jails have been releasing inmates early because of a lack of space.

"It will be very difficult to achieve an appropriate sentence of incarceration for Dr. Conrad Murray," Los Angeles District Attorney Steve Cooley, whose office prosecuted the case, told reporters earlier this month.

In addition, an attorney for Jackson's estate said in a court filing that the singer would have earned $100 million had he completed all 50 shows at London's O2 arena that he was scheduled to perform before his death.

Murray has been in jail since November 7 awaiting his sentencing hearing, due to a decision by Pastor to not allow him to remain free until that upcoming hearing.

That decision was made on the same day that a Los Angeles found Murray guilty of involuntary manslaughter after a six-week trial.

ich habe mir von den beiden videos zu diesem "fan-event" - das sinniger weise auch noch den namen "tribute to her (LaTunta's) brother" trug - lediglich ca. 2/3 des ersten videos angeschaut - dann hatte ich genug ;) .....

ich habe es mir auch nicht angetan, alles anzuschauen ... LaTuntas Stimme, ihre rhetorischen Fähigkeiten ~ die Kunst des Redens, ist nicht jedem gegeben ~ und dann auch das was sie gesagt hat, hält man einfach nicht aus ...

aber auch Joes "Genuschel" macht es nicht einfacher ... :D

Prince Jackson was not involved in the lawsuit since he was not part of the marketing agreement. It was not disclosed how much he was to be paid to attend and pose with the jackets.

tja, wenn man überzeugt davon ist, man sei unschuldig, dann setzt man alles dran, sich ins rechte Licht zu rücken, das hat Murray ja nun mit seiner Doku getan ...
und natürlich auch alles noch vor der Strafzumessung ... Staatsanwaltschaft und auch der Richter Pastor scheinen in Murrays Augen "weltfremd" zu sein ...

ja, natürlich Während seines Prozesses gestand Murray, dass er Michael Jackson mit einer kleinen Menge von Propofol helfen wollte, zu schlafen, aber nicht diese große Menge des Medikaments in seinen Körper "gepumpt" hat, das man gefunden hat, am Tag als MJ starb.

Weder Murray noch seinen Verteidigern [die tun jetzt wohl auf "blöd"] scheint wirklich klar zu sein, für was Murray nun eigentlich verurteilt worden ist ... :)

nicht übersehen sollte man auch Walgren's/Brazil's forderung, Murray in einem staatsgefängnis und NICHT in einem bezirksgefängnis inhaftieren zu lassen.... in einem staatsgefängnis bestehen kaum bis gar keine chancen auf hausarrest und/oder halbierung der haftzeit ;) ....

dann kann man doch nur hoffen, dass Murray in ein Staatsgefängnis kommen wird, um seine Haftstrafe dort zu verbüßen ...

Twin Tower Jail ist ja ein "Hochsicherheitsgefängnis" ... ist es nicht auch ein Staatsgefängnis ????

Wikipedia und alles, was dazu gehört, ist eine ausgesprochen beliebte quelle bei der suche nach informationen ;).... was vielen leider nicht bewusst ist, ist die tatsache, dass die dortigen beiträge von JEDERMANN geschrieben und sogar vorhandene geändert/bearbeitet werden können.... und wie wir mittlerweile wissen ;), gibt es nicht selten selbsternannte "experten", die meinen, über alles ganz genau bescheid zu wissen..... nun kann jeder für sich selbst entscheiden, welchen wert die vermeintlich tollen informationen von Wikepedia tatsächlich haben :).....

im fall der Wikipedia-erklärung für den begriff "Soziopath" ist grundsätzlich festzustellen, dass diese erklärungen gar nicht mal wirklich falsch sind ;).... die erläuterungen hierzu sind aber so gefasst, dass sie für medizinische laien missverständlich sind, was dann zu nicht unwesentlichen fehlinterpretationen führen kann....

deshalb noch mal etwas ausführlicher:

1. es gibt klassifikationsbestimmungen/-systeme für krankheiten.... für europa gilt hier die s.g. "ICD-10" klassifizierung, für USA sind diese klassifizierungen in der APA (Amerikanische Psychiatrische Vereinigung) geregelt.... man versucht hier eine weltweite einigung zu erzielen, die z.T. auch bereits gelungen ist, so u.a. bei den "antisozialen/dissoziale persönlichkeits- und verhaltensstörungen"....

2. unter "F60-F69" der "ICD-10" klassifizierung sind die spezigischen persönlichkeits- und verhaltensstörungen im detail klassifiziert und unter "F60.2" findet man das krankheitsbild "dissoziale Persönlichkeitsstörung", was identisch ist mit der APA-klassifizierung..... die ziffer "F60.2" würde man z.B. auf einer AU-bescheinigung als diagnose finden - da jedem arzt und auch den krankenkassen diese klassifizierungen bekannt sind, wissen diese damit bescheid, welche diagnose bei dem patienten gestellt wurde, ohne dass diese auch für medizinische laien sofort erkennbar ist, was u.a. bei einigen krankheiten zu zusätzlichen sozialen problemen führen könnte.....

3. das eigentliche bzw. medizinische krankheitsbild, dass man u.U. Murray zuschreiben kann, lautet also "antisoziale/dissoziale persönlichkeits- und verhaltensstörung"..... soziopathisches VERHALTEN kennzeichnet jedoch lediglich eine untergruppe dieser art von persönlichkeitsstörungen - es ist KEINE eigenständige krankheit, aber der veraltete begriff "Sozioptathie" hat sich als solche einfach in den köpfen medizinischer laien so festgesetzt ....

hier kann man die "ICD-10" klassifizierungen zu "antisozialen/dissoziale persönlichkeits- und verhaltensstörungen" sowie deren jeweilige ein- und ausschlüsse von verhaltensmustern bzw. persönlichkeitszügen sehr schön im detail nachlesen ;)

na, die "Schlagzeile" verspricht doch wieder mal etwas, was gar nicht erfüllt wird ... hätten sich die Schreiberlinge mal die Aufstellung der angebotenen "Gegenstände" genauer angesehen, dann hätten sie feststellen können, dass dieses "berüchtigte" Bett, nicht mehr aufgeführt wird ... also so nicht zum Verkauf steht ...

diese Gegenstände sind NICHT das Eigentum von MJ gewesen ... daher ja auch nur eine Auktion unter dem Namen 100 North Carolwood Drive ...

aber sie befanden sich in den Räumen, in denen MJ vielleicht auch mal "geatmet" hatte ... so ganz genaues, weis man nicht ... vielleicht hat MJ ja einiges auch mal berührt ... ohhhh, wie krank ist doch diese "Gesellschaft" ... :)

Michael Jackson's fans are notorious for their rabid worship of the late pop star. But will they pony up big bucks to own the bed on which their icon died? We will find out on December 17, when Julien's Auctions Gallery will auction off the contents of the rented Holmby Hills, California, home that Jackson was renting at the time of his death.

Though the announcement of the sale does not mention Jackson by name, it lists a variety of fine art and furnishings from the residence, including a gilded Louis XV headboard (est. $3,000/$4,000) and a $30,000 watercolor painting by Maurice Utrillo. An Associated Press story revealed that the sale of contents of 100 North Carolwood Drive will comprise items left behind by Jackson.

The singer passed away in the home on June 25, 2009, and on Monday his personal physician, Dr. Conrad Murray, was found guilty of one felony count of involuntary manslaughter in Jackson's death. Among the pieces of evidence brought up by prosecution witnesses attesting to Murray's medical incompetence was the fact that he gave Jackson CPR on a bed instead of a hard surface. The hundreds of items up for sale in the auction include the queen-size bed where Jackson slept.

In an ironic twist, just as Murray was getting news of the guilty verdict, reporters were being taken through the three-story home on a private tour in order to publicize the auction.

"We want to preserve the history of these items," said auctioneer Darren Julien of the contents, which include paintings and sculptures Jackson surrounded himself with in the rented home as he tuned up for his planned "This is It" comeback tour. The house, where Jackson lived with his three children from December 2008 until his death, is also separately up for sale.

One of the most-personal items on the block ($400) is a chalkboard that hung in the home's kitchen that features a note from the kids that reads, "I (heart) Daddy. SMILE, it's for free." A mirror on an antique armoire in Jackson's private bedroom featured a message the star wrote to himself that read, "TRAIN, perfection, March April. FULL OUT May," a reference to the grueling rehearsal schedule the 50-year-old was keeping up as he prepared for the string of concerts that were to begin in London in July 2009.

Reporters also saw a "medication room," the bedroom shown in evidence photos at Murray's trial, where fans can pick up upholstered chairs smudged with Jackson's makeup. An attorney for Jackson matriarch Katherine Jackson said that the family is aware of the auction and has made certain that the event does not use Michael's name or likeness to help sell the items; Jackson's name is not mentioned in the promotional materials for the auction.

ja, diese Erfahrung ist auch noch nicht mal so lange her ... :D ... aber ohne die entsprechenden Kenntnisse, ist es doch schwierig, die Einträge bei Wikipedia zu widerlegen ...
