Lawyer for Conrad Murray accuses Michael Jackson death investigator of making mistakes

(CBS/AP) LOS ANGELES - The defense attorney for the doctor charged in Michael Jackson's death is calling into question a coroner investigator's notes and recollections of items found in the singer's bedroom after he died.

Elissa Fleak denied defense attorney Ed Chernoff's contention Thursday that she had made a number of mistakes in preparing reports on the death.

Chernoff noted during cross-examination that Fleak didn't note that she had found a bottle of propofol inside an IV bag until March 2011, nearly two years after the singer's death.

The lawyer also questioned whether she had heard that detail from testimony by bodyguard Alberto Alvarez, who told jurors he saw the bottle inside the bag before following the instructions of Dr. Conrad Murray to put it inside a bag.

Fleak also testified that she accidentally touched a syringe in Jackson's bedroom, leaving a thumbprint.

Murray has pleaded not guilty to involuntary manslaughter.

UPDATE 11:30 a.m.: Redirect falls back to the prosecution, and the district attorney did his best to get across the information that there is no such thing as a mistake-proof investigation. "Did you conduct a perfect investigation in this case?" he asked Fleak. "No." "Have you ever?" "No." "Have you done your best to accurately describe what you've seen and heard? "I have." She was dismissed and prosecution proceeded to read out a three-page stipulation (facts agreed to by both sides) on fingerprints found on various pieces of evidence before calling L.A. County Coroner toxicologist Dan Anderson to the stand. Proceedings have since broken for lunch and his testimony will resume at 1:30 p.m.

UPDATE 10:45 a.m.: Defense attorney Ed Chernoff continues his attempt to catch Fleak out, asserting that she was neglectful to accurately collect and note evidence from Jackson's bedroom. Of particular issue to Chernoff was her failure to mention the IV bag and stand in the room when she first entered it on June 25, 2009, only noting it in her case notes for the first time on June 29. "Is it a mistake?" she said. "I could've described it in more detail." "You could have described it at all," Chernoff replied.

After showing photos of the bedroom, the defense also questioned Fleak on whether she ever took into evidence an open bottle of Naked juice that sat on Michael's bedstand. She admitted that she did not, but defended their collection, saying that there was a difference between the case notes and the evidence log, and that the former was not intented to make note of every item found.

UPDATE 10:00 a.m.: L.A. County Coroner investigator Elissa Fleak is back on the stand, testifying about the drugs and drug paraphernalia she discovered in Michael's bedroom and bathroom, with pictures getting shown of the syringes, disposable resuscitators and other items found. The defense is also pressing her on which rooms she searched in Jackson's home and why. Court has recessed on a morning break and will testimony will resume at 10:30 a.m.

Over the past week, the prosecution has done its best to expose the laundry list diaper bag's worth of prescription drugs that Conrad Murray had been administering to Michael Jackson. Today, the D.A.'s team will attempt to explain just why that combination was so lethal and how, exactly, each of the dosages interacted with each other.

Naturally, then, among those expected to take the stand today are a toxicology expert, as well as a coroner's investigator. The prosecution has contended all along that the drugs, administered by Murray, killed Jackson. The doctor's defense, however, claims that Murray was already in the process of weaning the pop star off of the meds and contend that Jackson himself self-administered the fatal dose of propofol on June 25, 2009, while Murray was out of the room.

Today's cross-examination of coroner's investigator Elissa Fleak was slow, methodical... and beneficial for the defense of Dr. Conrad Murray

First, procedurally, they were not as aggressive as they could have been and as many less-experienced attorneys would have been with a key witness who might have made several errors.

The danger of a harsh cross is that it turns the jury off to you and your client. Ed Chernoff had the jury laughing twice during the cross exam with self-deprecating comments. While the cross was stern, it was never rude or improper.

Secondly, substantively, demonstrating that the orange juice bottle was never tested for propofol and that the I.V. bag had clear –not milky– fluid in it, strongly supports that Michael may have poured the propofol into the O.J. and drank it.

Also, if there was no propofol residue in the I.V. at the time of the death, propofol is not the manslaughter weapon and Dr. Murray is not culpable.

As a smart viewer said, "If the I.V. fluid ain't milky, Conrad ain't guilty!"

Later today, jurors may finally hear Dr. Conrad Murray tell HIS side of the story ... when prosecutors play audio of the interview he gave to LAPD investigators just two days after Michael Jackson died.

They're making their way to the key cop in the investigation -- Orlando Martinez -- who headed up the investigation and probably knows more about the case than anybody.

Von wegen MJ war Drogenabhängig, die haben den ja auf ALLES getestet und fast alles wurde nicht in seinem System festgestellt.

ja kein demerol wie es aussieht und auch sonst scheint er nicht mehr Medikamente als so manch anderer genommen zu haben ... eigentlich ... jedenfalls nur Medis die er brauchte ...... ich bekomme auch antidepressiva , carbimazol ( schilddrüsenmedikament) und mehrere sprays unter anderm eins mit hoher dosis cortison wegen allergien asthma usw ... bin ich darum nun auch drogensüchtig(medikamentensüchtig) ???
