Michael Jackson's mother to testify in AEG wrongful-death case

By Kate Mather
July 18, 2013, 6:09 p.m.

Michael Jackson's mother is slated to take the stand Friday for the first time in the wrongful-death suit she and her late son's three children brought against the company that was promoting the singer's ill-fated comeback tour.

Katherine Jackson, 83, and her grandchildren -- Prince, Paris and Blanket -- have sued AEG Live, saying the entertainment giant negligently hired and controlled the physician who gave the singer a fatal dose of the anesthetic propofol in 2009, days before his "This Is It" tour was to open in London.

AEG says it was Jackson who hired Dr. Conrad Murray, and that any money the company was supposed to pay the doctor was an advance to the singer.

Murray is serving jail time for his involuntary manslaughter conviction.

Katherine Jackson is not the first family member to testify in the months-long trial, but the family matriarch may be among the most anticipated witnesses.

Michael Jackson's eldest son, Prince, took the stand in late June, when the 16-year-old testified about his childhood, his father's preparations for the "This Is It" tour, and the day the singer died.

Two of Michael Jackson's nephews have also testified, including TJ Jackson, who shares guardianship with his grandmother over the King of Pop's children.

Katherine Jackson has spent much of the trial seated in the front row of the courtroom, where she has been well-received by her son's fans who also routinely watch the proceedings.

On a recent day, some of the fans lined the hallway as Katherine Jackson walked to the elevator, flanked by her nephew, Trent, and security.

The fans waved as the matriarch moved slowly past.

"We love you. We love Michael so much," they said, blowing kisses.

She lifted her hand to wave before leaving.

Michael Jackson
I Didn't Want to Be
Moonwalkin' at 50!

0718-mj-moonwalk-getty-3

Katherine Jackson may have suffered a legal blow over some jokes her son Michael told years before his death -- specifically, that he didn't want to be a crotchety old moonwalker.

We've just gotten our hands on a portion of a transcript from Katherine's deposition in her wrongful death case against AEG Live. Katherine says she was surprised when Michael agreed to do the "This Is It" tour because "he was always making a joke about he don't want to be doing the moonwalk on stage when he's 50 years."

Katherine's video deposition was just played for the jury.

Joke or no joke ... you can bet AEG is going to use this to convince the jury that Michael's shelf life as a performer was limited. Translation, he wouldn't be making a lot of money by doing concerts.

Michael Jackson's mom set to testify in death trial

By Alan Duke, CNN
updated 7:50 PM EDT, Thu July 18, 2013

STORY HIGHLIGHTS

* Paris testifies: Jackson told his children "we were going around the world on tour"
* Jackson matriarch Katherine Jackson gets the last word before her lawyers rest case
* Experts says Jackson would have earned $1.5 billion from touring and sponsorship
* AEG Live confirms they will not call Dr. Conrad Murray to testify.

Los Angeles (CNN) -- The wrongful death trial of Michael Jackson's last concert promoter is about to get a lot uglier, if defense lawyers live up to the promise of their opening statements.

AEG Live lawyers this week brought up the child molestation charges against Jackson and the 2002 incident in which the pop star "dangled" his infant son on a Berlin hotel balcony.

But Jackson family matriarch Katherine Jackson will get to speak before her lawyers rest their case, likely Friday, and the defense begins calling witnesses on Monday.

Jackson's 83-year-old mother, who has sat on the front row of the small courtroom nearly all of the 51 days of testimony, is expected to testify about her son's close relationship to his three children -- who also are plaintiffs in the lawsuit -- and about his plans for his later years of life.

If jurors decide that AEG Live is liable in Jackson's death -- while under the care of a doctor the family contends AEG Live hired, retained or supervised -- they could award damages based on the loss of the mother and children's relationship with him and the amount of money he was unable to earn because his life was cut short.

AEG Live lawyers argue that Jackson, not their executives, chose and controlled Dr. Conrad Murray, and they had no way of knowing about the dangerous surgical anesthesia infusions the doctor was giving the singer to treat his insomnia. Those infusions occurred most nights in the two months before the pop star died from a propofol overdose.

Touring till 66?

Paris Jackson made another appearance in the trial this week -- via a video of her deposition in March. Jurors saw a clip of AEG Live lawyer Marvin Putnam asking the 15-year-old what her father told her about his "This Is It" tour:

Putnam: "Did he explain to you how long the tour was going to last?"

Paris: "I assume a long time since it was a world tour, but those usually last a long time"

Putnam: "How did you understand it was a world tour?"

Paris: "Because he told us."

Putnam: "What did he tell you?"

Paris: "That we were going around the world on tour."

Certified public accountant Arthur Erk, who has managed and audited the business affairs of many top artists, testified Wednesday that he is "reasonably certain" that Michael Jackson would have performed 260 shows around the world as part of his "This Is It" tour. He would have earned $890 million over the three years of concerts in Europe, Asia, South America, North America and Australia, Erk said.

Jackson would have earned at least $1.5 billion from touring, endorsements and sponsorships had he not died preparing for his comeback tour, Erk said.

AEG Live's unprecedented sellout of 50 shows scheduled for London's O2 Arena in 2009 and 2010 proved there was "pent-up demand" to see Jackson live, despite controversies that had tarnished his reputation in the years since his last tour in 1998, Erk said.

An e-mail from AEG Live CEO Randy Phillips said fans bought all 750,000 tickets put on sale for 31 shows in March 2009 in just two hours. Enough buyers were registered to sell out another 100 shows, Phillips wrote.

"Dude, we're going to sell out a ridiculous amount of tickets," AEG Live Co-CEO Paul Gongaware wrote in an e-mail. "We've got to get Mikey to add more shows."

Jackson's manager quickly approved another 19 shows, bringing the total to 50.

"Ten million tickets for the rest of the world? They would have gobbled up those tickets in seconds," Erk said.

AEG Live lawyer Sabrina Strong challenged Erk's estimate, asking if any other act has ever made as much money on a tour. "No," he said. "This would have been a record-breaking world tour."

Jackson would have done another 195 shows over four more world tours before retiring from the road at age 66, Erk predicted.

Lead defense lawyer Marvin Putnam called Erk's estimates "a creation, a fabrication" which suggests Jackson would have made more after age 50 that he did in the three tours during the "height of his fame."

Jackson never intended to perform after the 50 shows in London, Putnam said.

AEG Live showed jurors a video clip of Katherine Jackson's deposition, in which she said her son would joke that he "didn't want to be moonwalking on stage at 50." A Jackson lawyer said it was something Jackson said when he was much younger and 50 seemed old.

In fact, Jackson was 50 when he signed a three-year contract with AEG Live for his comeback tour, which would have likely included his famous moonwalk dance steps as he performed "Billie Jean."

"We announced that we're going to have one tour in London, that's what was announced, and it was called 'This Is It,' meaning in London, this show is it," he said. "This show is it. This is the last thing he's ever going to do. As a result of this being his final performance ever, to be at the O2 in London, there was enormous response, understandably, and therefore we sold 50 shows."

With the Jackson case ending -- which Putnam called "ridiculous" -- "now we're going to start to show what actually occurred here," he said.

No Conrad Murray testimony

AEG Live's defense team confirmed Wednesday that they would not be calling Murray to testify.

"I have no intention of calling him myself, unless it's requested, your honor," Putnam said, replying to the judge's question about his plans.

Until now, AEG Live lawyers have suggested they might call Murray, who is serving a four-year jail sentence for involuntary manslaughter, to the witness stand.

Murray's lawyer gave the Jackson and AEG Live lawyers a sworn statement from the doctor before the trial began stating that he would invoke his constitutional protection against self-incrimination by refusing to answer questions if subpoenaed.

See you in September

Jurors, who were told when the trial started in April that it could end sometime in August, appeared unfazed when Los Angeles County Superior Court Judge Yvette Palazuelos told them this week that it is likely to extend into mid-September. Putnam estimated this week that he needs about 30 days in court to present his defense after the plaintiffs rest.

The jurors often have laughed and smiled in reaction to testimony and the interplay between Jackson lead lawyer Brian Panish, the judge and the AEG defense team.

For example, when Palazuelos ordered Panish to turn around and face the bench while AEG attorney Sabrina Strong cross-examined Erk, jurors seemed amused. Panish, whose seat was just in front of Strong's lectern, had been looking directly up at her at close range.

There were no laughs in the hallway after court on Tuesday when Panish and Putnam exchanged words. The two lawyers were standing about 15 feet apart, each talking to reporters, when they began directing their words at each other. The court clerk interrupted the heated conversation, threatening to summon deputies.

Palazuelos lectured the lawyers in her chambers the next morning and imposed new rules that bar them from speaking to journalists in the hallway.

Katherine Jackson to testify at LA trial

By Michael Thurston (AFP) – 4 hours ago

LOS ANGELES — Michael Jackson's mother Katherine will finally take the stand Friday at her trial against tour promoters AEG Live, who she alleges negligently hired the doctor convicted over the star's 2009 death.

After sitting through 12 weeks of often-emotional testimony, the 83-year-old will give her account of what happened in the weeks and months before her son died while rehearsing for a doomed comeback concert tour.

The family matriarch is the main plaintiff in the multi-million dollar case against AEG Live, and the second immediate family member to testify after the late star's son Prince gave testimony last month.

She claims AEG Live negligently hired and retained doctor Conrad Murray to look after Jackson as he rehearsed in Los Angeles for his "This is It" comeback tour, which planned to start with 50 shows in London.

Murray was found guilty of involuntary manslaughter in 2011 over Jackson's death on June 25, 2009 from an overdose of surgical anesthetic propofol, administered to help the singer cope with chronic insomnia.

Jackson's 16-year-old son Prince testified last month his exhausted father warned that tour promoters AEG Live were going to "kill" him as he rehearsed for the marathon concert tour.

"He just wished he had more time for rehearsals," he told the wrongful death trial, also recounting the harrowing scenes on the day Jackson died, with his younger sister Paris "screaming" as Murray battled in vain to revive him.

In recent days the Jacksons' lawyer Brian Panish has focused on financial details, calling an accountant expert witness, Arthur Erk, who testified Jackson could have earned up to $1.5 million with the London concerts and a subsequent world tour.

Emotions have also spilled over outside the courtroom: on Tuesday this week a shouting match erupted in the hallway as lawyers spoke to reporters about the day's hearing.

Panish and his AEG rival attorney Marvin Putnam have repeatedly clashed during the trial. Putnam is expected to begin presenting his case next week, once Katherine Jackson has testified to wrap up the Jackson case.

Paris Jackson, 15, was originally expected to be among witnesses called at the Jackson v AEG trial, which is expected to last through August.

But she is now unlikely to do so, after being rushed to the hospital after trying to commit suicide at the family home in Calabasas, northwest of Los Angeles, last month.

She had previously been treated for depression and remains under medical supervision. Her testimony has been heard during the trial, in the form of video of a deposition she gave in March.

Katherine Jackson's testimony is expected to close the Jacksons' case at the trial, after nearly three months of hearings in a downtown LA courtroom a stone's throw from where Murray was convicted in 2011.

She has attended much of the trial, sitting in the front row often with another family member, on occasion fighting to contain her emotion when harrowing details of her son's final days are discussed.

She is expected to be on the stand for much of the day. Her lawyer told LA Superior Court Judge Yvette Palazuelos that the octogenarian will need regular breaks, given her advanced age.

She is due to take the stand some time after 9:30 am (1630 GMT) Friday.

Michael Jackson's mom Katherine set to give testimony in wrongful death case against concert promoter

Michael Jackson's 83-year-old mom Katherine will face a jury to give testimony about her controversial superstar son in her wrongful death case against concert promoter AEG Live.

By Nancy Dillon / NEW YORK DAILY NEWS
Friday, July 19, 2013, 2:30 AM

Katherine Jackson is the final plaintiff's witness for wrongful death case against AEG Live.

Michael Jackson's beloved mom is expected to face a jury for the first time in her 83 years Friday and give emotional testimony about her peerless and polarizing musical genius son.

The matriarch is slated as the final plaintiff's witness for her billion-dollar wrongful death case against concert promoter AEG Live.

"Katherine's going to talk about Michael growing up as a child, his life, his family, his career, his relationship with his children and how his death has affected her and her children and Michael's children," her lawyer Brian Panish told the Daily News.

"It will be off the charts," in terms of emotions, he said.

Jackson alleges that AEG negligently hired and supervised the doctor now serving four years in connection with Michael Jackson's June 2009 overdose death.

The closely watched trial started in April and is expected to stretch into September with defense witnesses for AEG starting next week.

Asked Thursday if Katherine was nervous about tough questions related to her famous family, Panish shook his head.

"You think she's a tough woman? No question," he said.

The mother of nine and legal guardian of Michael's three kids has attended much of the downtown Los Angeles trial but was absent Thursday to get her hearing aids checked in preparation for her testimony.

file-usa-michael-jackson-trial-day-64

Jackson is expected to talk about her son's life and how his death has affected the family.

"She listens really hard, and that tires her," Panish warned the judge Thursday as he proposed a series of hourly breaks Friday. "She gets tired in the afternoon."

Katherine is suing AEG for wrongful death claiming the concert giant negligently hired and supervised the doctor now serving four years in connection with Michael's June 2009 overdose death.

AEG denies any wrongdoing, claiming it was Michael who demanded and personally hired Dr. Conrad Murray and secretly begged for the surgery-strength anesthetic that killed him.

In his opening statement, AEG lawyer Marvin Putnam said AEG had no idea Michael was engaging in nightly intravenous infusions of propofol in a reckless and misguided attempt to treat his insomnia.

"With Michael Jackson, the public and private were two very different worlds," he said. "AEG, like everyone else, was an outsider, outside the security gates."

Prince Jackson
I FEEL THE NEED
FOR SPEED!

Prince Jackson picked up something in his pickup Wednesday -- a speeding ticket.

TMZ has learned ... Michael Jackson's eldest son was nabbed by cops near his Calabasas home for going around 40 mph in a 25 zone.

FUN FACT: Prince was stopped in the area where Justin Bieber and his Lil friends race his Ferrari -- at much higher speeds. FYI -- Justin and the Lils have never gotten a speeding ticket in that area.

As for Prince -- well, the 16-year-old must now dig deep, because the fine is around $250.

Already blowing the $10 billion nest egg he's after ... kids.

Prince Jackson was stopped by police on Wednesday for speeding near his Calabasas, California home, according to reports.

The 16-year-old aspiring actor - the oldest son of the late King of Pop, was allegedly going 40 mph in a 25 mph zone while driving a Ford pickup truck, according to TMZ.

He is expected to have to pay a $250m fine.

MJ's kids have been going through a lot lately. June 25 marked the fourth anniversary of their father's death, and the children have had to relive his last days during the wrongful death trial the family filed against AEG, the concert promoter that was in charge of the singer's This Is It tour.

Both Prince and his sister Paris testified during the trial.

Prince revealed personal details during his testimony of his life and shared stories about his childhood with the King of Pop.

'My dad taught me everything was a learning experience,' the teenager told the jury, adding that he and his father wrote screenplays together and watched movies without sound to study the visual components of filmmaking.

Paris was hospitalized in early June for attempted, and was moved from an LA area hospital to a treatment centre last week.

The family decided Paris, who slashed her wrists and overdosed on pills, should go to another treatment centre rather than home, a source told People magazine.

'The feeling is that Paris is still a danger to herself,' the insider explained. 'Both Katherine and Debbie want her to get the help that she needs.'

Prince will have to shell out around $250 to pay his ticket - nearly $200 more than the parking ticket he received a few weeks ago.

A-Rod’s success after steroid scandal used as example in Michael Jackson wrongful death trial
As lawyers sparred over Michael Jackson's earnings potential, the Jackson family's lawyer used Alex Rodriguez as an example of a star who overcame scandal to make big money

NEW YORK DAILY NEWS
Wednesday, July 17, 2013, 9:47 PM

A lawyer for the Jackson family used Alex Rodriguez as an example of a mega-star who has overcome scandal to make big bucks. The argument in the case is whether Michael Jackson’s acquittal at his molestation trial years ago damaged his earnings potential. A-Rod has overcome steroid scandal in the past, but now faces a new round of accusations, and recovery from a hip injury.

A-ROD can’t crack the Yankees lineup — but he did get a mention Wednesday during the wrongful death trial Michael Jackson’s family is waging against concert promoter AEG Live.

“Let’s talk about A-Rod. Have there been allegations against Mr. Rodriguez about certain activities?” Jackson family lawyer Brian Panish asked a witness in an apparent reference to the accusations of steroid use dogging the Bombers third baseman.

“They’re still coming about, surfacing every once in a while,” responded Arthur Erk, a Manhattan accountant called to the stand by the Jackson family.

Panish brought up A-Rod, along with Tiger Woods, to draw examples of mega-stars who made big money after being struck by scandal.

“How is he doing?” Panish continued, referring to A-Rod.

“At least according to media reports, he’s still doing fairly well,” Erk replied.

At issue was whether scandal — in this case Michael Jackson’s molestation trial — would have hurt his earnings. Erk caused a stir during the civil trial earlier this week when he testified that, in his estimation, the King of Pop could have made $1 billion or more had he lived to go on his long-planned comeback tour, and done a host of subsequent tours.

AEG lawyers had tried to knock down that testimony, citing alleged damage to Michael’s reputation caused by his past molestation trial and his wacky behavior, including a 2002 episode in which he was photographed holding his son Blanket, then just a baby, out of a fourth-story window. Panish dropped A-Rod’s name in a bid to counter those arguments.

A-Rod has millions left on his contract, but he’s now hurt, rehabbing in the minors, and is being investigated by Major League Baseball for alleged ties to a medical clinic in Florida that is at the heart of baseball’s newest steroid controversy.

Erk defended his eye-popping estimate Wednesday by noting that Beyoncé recently scored a reported $50 million sponsorship deal with Pepsi. Erk argued that Jackson would have stood to cash in on sponsorship deals.

Michael Jackson’s family is suing AEG Live, the firm behind his ill-fated comeback tour, for allegedly failing to supervise the doctor who was convicted of manslaughter for supplying the singer with the surgery-strength anaesthetic on which he overdosed in 2009.

AEG lawyer Sabrina Strong attacked the comparison to Queen Bey, highlighting the years of child molestation accusations against Michael that culminated in a 2005 trial in which the Gloved One was acquitted.

“(Beyonce) has never been a defendant in a criminal trial,” Strong suggested to the jury. “In fact, Beyonce has never really suffered any negative publicity.”

The Jackson family’s lawsuit says that AEG — the firm behind Jackson’s comeback tour — negligently hired the doctor who was convicted of manslaughter for supplying the singer with the medication on which he overdosed in June 2009.

AEG execs deny any wrongdoing, arguing that Michael personally hired Dr. Conrad Murray and kept his reckless use of the surgery-strength anesthetic propofol a closely guarded secret.

Also on Wednesday, the jury heard videotaped testimony from Paris Jackson, the King of Pop’s troubled 15-year-old daughter.

Paris, whose testimony was recorded during a deposition in March, said her father still had hits up his sleeve, but needed to take a break from touring.

A lawyer for AEG had asked her about claims her famous dad planned to “retire” from the music business.

“He still had a lot of music that he was still working on, but he kind of needed to relax,” Paris said as the jury watched the footage on a huge courtroom video screen.

“Did he tell you he wasn’t going to tour anymore after O2,” AEG lawyer Marvin Putnam asked, referring to the 50 shows that were booked at the famous London arena but ultimately cancelled following Michael’s overdose death on June 25, 2009.

“Yes,” Paris replied.

Jurors heard previously recorded testimony Wednesday from Michael Jackson’s troubled teenage daughter Paris, 15, who tried unsuccessfully last month to take her own life.

AEG played the deposition testimony in an attempt to contradict Erk’s projection that Michael could have pulled in an earnings bonanza had he lived to take the “This Is It” tour across the globe.

Erk had testified that he believed Michael could have parlayed his success in London into higher ticket prices in other countries, and four more world tours stretching into 2026.

Jurors then saw a second clip of Paris’ testimony requested by lawyers for her grandmother, family matriarch Katherine Jackson.

“Did (your dad) explain to you how long the (‘This Is It”) tour was going to last,” Putnam asked Paris in the second excerpt shown Wednesday.

“I assume a long time since it was a world tour,” she said. “Those usually last a long time ... He told us that we were going around the world on tour.”

Doctors have been treating the teen since early June, when paramedics rushed to her Calabasas, Calif., mansion for a call that she downed 20 Motrin pills and slashed her arm with a kitchen knife in an apparent suicide try.

Sources told the Daily News the bid was spurred by a longstanding battle with depression, the stress of the trial and relentless online bullying.

In recent days she has been transferred from UCLA Medical Center to an undisclosed rehab center — marking the first time since the suicide attempt that she has not been hospitalized.

“She’s doing much better. Everything is moving along, but she still needs intensive treatment,” a source close to the family told The News Wednesday.

Asked how long the teen is expected to remain in residential rehab, the source said at least a month.

“I wouldn’t say she’ll be out in a matter of weeks. I think we have a long road. I think it’s an ongoing process,” the source said. “She’s probably going back to school in the fall, but it won’t be (her old school) Buckley.”

Katherine Jackson
Hurts to Hear MJ Called
'Freak'

7/19/2013 1:00 PM PDT

0719-katherine-jackson-tmz-3

Katherine Jackson testified in her wrongful death lawsuit against AEG Live ... it's devastating to hear witnesses and lawyers refer to her dead son as "lazy" and a "freak."

She said, "It's hard to sit here in court and listen to all these things ... My son was sick and nobody was trying to help him."

When she met Dr. Conrad Murray -- the man who killed MJ with a fatal dose of Propofol -- she said she immediately thought the doc WASN'T the right person to care for her son.

She said, "My son needed another doctor."

Katherine is trying to prove AEG was negligent in hiring and supervising Dr. Murray, and is therefore responsible for the singer's death.

Michael Jacksons Mutter leidet im Prozess

Samstag, 20.07.2013, 08:54

Michael Jackson's mom: 'I want to know what really happened'

* "My son was a very good person," Jackson's mother testifies
* Expert says Jackson would have earned $1.5 billion from touring and sponsorship

Los Angeles (CNN) -- Michael Jackson's mother told jurors she filed a wrongful death lawsuit against AEG Live "because I want to know what really happened to my son."

Katherine Jackson, likely the final witness as her lawyers conclude their wrongful death case against the pop icon's last concert promoter, began her testimony Friday and will conclude it Monday in a Los Angeles court.

"The most difficult thing is to sit here in the court and listen to all the bad things they say about my son," Jackson testified.

The 83-year-old matriarch of the world's most famous entertainment family sat on the front row in the small courtroom for most of the 51 previous days of testimony.

"A lot of the facts that have been said are not the truth," she said. She said contrary to what an AEG Live executive wrote in an e-mail as Jackson prepared for his comeback concerts in 2009, her son was not lazy.

But she especially objected to an e-mail from AEG parent company's general counsel that called Jackson "a freak" on the same day his company's top executives were going to his house to sign the "This Is It" tour contract.

"He's not here to speak for himself," his mother said. She said she would "try my best" to speak for the pop icon.

Jurors leaned forward and listened closely during Jackson's testimony and as her lawyer showed them video of her son performing as a child.

The lawsuit filed by Katherine Jackson and on behalf of the singer's three children contends AEG Live is liable for the death of Jackson because it hired, retained or supervised Dr. Conrad Murray. The doctor was convicted of involuntary manslaughter.

AEG Live argues it was Jackson, not their company, who chose and controlled Murray, who admitted giving Jackson nightly infusions of a surgical anesthetic the coroner ruled killed him. Its executives had no way of knowing about the dangerous treatments Murray was giving Jackson in the privacy of his bedroom, AEG Live lawyers contend.

"Why are you here?" Jackson lawyer Brian Panish asked Katherine

"Because I want to know what really happened to my son," she said. "And that's why I am here."

Panish asked Jackson how it made her feel to have been asked probing and personal questions about her family by AEG Live lawyer Marvin Putnam during a dozen hours of deposition testimony.

"It makes me feel real bad, because my son was a very good person," she said. "He loved everybody, he gave to charity, he was in the Guinness Book of World Records for giving to charity."

Putnam faces the challenge of not appearing unkind to Katherine Jackson while also trying to discredit her testimony.

"Forget it," she said as she stopped before answering Putnam's question about why she initially included, and later dropped show director Kenny Ortega as a defendant in her lawsuit.

"Forget what ma'am?" Putnam asked.

Jackson remained silent for about a minute, staring back at Putnam.

Would it help to reread the question, he asked.

"No, it wouldn't be helpful," Jackson answered curtly.

The judge finally ordered the question stricken from the record because the answer involved privileged discussions with her lawyers.

Jackson returned to the stand after the lunch break but she told the judge she was tired after just a few more minutes of questioning by Putnam. The judge sent jurors home two hours early and will allow Katherine Jackson to resume her testimony Monday morning.

If jurors decide that AEG Live is liable in Jackson's death, they could award damages based on the loss of the mother's and children's relationship with him and the amount of money he was unable to earn because his life was cut short.

The wrongful death trial is about to get a lot uglier, if defense lawyers live up to the promise of their opening statements.

AEG Live lawyers this week brought up the child molestation charges against Jackson and the 2002 incident in which the pop star "dangled" his infant son on a Berlin hotel balcony.

Touring till 66?

Paris Jackson made another appearance in the trial this week -- via a video of her deposition in March. Jurors saw a clip of AEG Live lawyer Putnam asking the 15-year-old what her father told her about his "This Is It" tour:

Putnam: "Did he explain to you how long the tour was going to last?"

Paris: "I assume a long time since it was a world tour, but those usually last a long time"

Putnam: "How did you understand it was a world tour?"

Paris: "Because he told us."

Putnam: "What did he tell you?"

Paris: "That we were going around the world on tour."

Certified public accountant Arthur Erk, who has managed and audited the business affairs of many top artists, testified Wednesday that he is "reasonably certain" that Jackson would have performed 260 shows around the world as part of his "This Is It" tour.

Putnam called Erk's estimates "a creation, a fabrication" which suggests Jackson would have made more after age 50 that he did in the three tours during the "height of his fame."

Jackson never intended to perform after the 50 shows in London, Putnam said.

AEG Live showed jurors a video clip of Katherine Jackson's deposition, in which she said her son would joke that he "didn't want to be moonwalking on stage at 50."

"Michael said that quite a few years back and he was joking," his mother explained in her testimony Friday. "I thought it was funny and most of us said things like that. I used to think 50 was very old."

ABC News’ Lesley Messer and Vania Stuelp report:

Video and photos released in a wrongful death lawsuit against Michael Jackson’s concert promoter offered an intimate look into the life that Jackson shared with his three children, Prince, 16, Paris, 15, and Blanket, 11.

Lawyers introduced the images, later obtained by KABC, to support testimony by Michael Jackson’s mother, Katherine Jackson, 83, in her family’s lawsuit against AEG Live.

Katherine Jackson described her son as “a very good person” and “one of the best fathers.”

“[He wanted to be a parent] more than anything else,” she said, according to People magazine. “You’d be surprised. It just changed his life.”

Amid the evidence presented in court, there was even a photo shown of Jackson bonding with his parents.

“My sweet little boy,” said Katherine Jackson, 83, before she told the judge that she was too tired to continue testifying this afternoon. “Michael was always sensitive and loving.”

Michael Jackson died in 2009 after being given a lethal dose of the drug propofol.

The Jackson family has sued AEG Live, claiming that the tour promotion company was negligent by hiring Dr. Conrad Murray to care for Jackson. In 2011, Murray was convicted of involuntary manslaughter in conjunction with Jackson’s death.

Michael Jackson's mother weeps in court, blasts critics

Agence France-Presse
Posted at 07/20/2013 8:58 AM | Updated as of 07/20/2013 8:58 AM

LOS ANGELES - Michael Jackson's mother Katherine broke down in tears Friday recalling the day her son died, as she testified against tour promoters AEG Live whom she blames over his 2009 death.

Taking the stand 12 weeks into a civil trial, she also lashed out at critics who described the star as a "freak" and said AEG Live should have done more to help the late singer, clearly ill in the weeks before he died.

"When I lost Michael, I lost everything," the 83-year-old said, repeatedly wiping away tears as she was questioned by her lawyer Brian Panish in the Los Angeles courtroom where the wrongful death trial started in late April.

"Michael and I were very close. Michael was the the type of son every mother would want," she added, describing him as "very shy."

Jackson accuses AEG Live of pushing her son too hard as he rehearsed in Los Angeles for a series of "This is It" comeback concerts in London and of negligently hiring doctor Conrad Murray to look after him.

Murray was convicted of involuntary manslaughter in 2011 over Jackson's June 25, 2009 death from an overdose of the surgical anesthetic propofol, administered to help the 50-year-old singer with chronic insomnia.

Jackson's 16-year-old son Prince testified last month his exhausted father warned AEG Live was going to "kill" him as he rehearsed for the marathon concert tour.

Katherine Jackson echoed this Friday, saying the tour promoters failed to properly supervise Murray and to respond to clear signs her son was seriously ill in the weeks and days before his death.

"My son was sick... and they knew he was sick, and nobody said 'call the doctor,'" she testified, adding she didn't know who Murray was until after Jackson's death.

"That doctor was for his children, I didn't know who it was," she said, adding: "My son needed another doctor."

In tense exchanges with AEG's lawyer Marvin Putnam, who also questioned her, she repeatedly lashed out at critics of her son.

"It's hard for me sitting in court and listening to people call my son a freak, saying he was lazy," she said, staring intently at Putnam.

"He was not a freak," she added.

Putnam asked her about testimony by tour director Kenny Ortega earlier in the trial, who used the word "lazy" in the sense that Jackson was reluctant to rehearse.

"He knew what he was doing. He didn't need that much rehearsing," she said, adding that, in June 2009, her son "was sick and couldn't rehearse."

Emotions have also spilled over outside the courtroom.

On Tuesday, a shouting match erupted in the hallway as lawyers spoke to reporters about the day's hearing.

Panish and Putnam have repeatedly clashed during the trial. Putnam is expected to begin presenting his case next week, once Katherine Jackson has testified to wrap up the case.

Katherine Jackson's testimony caps nearly three months of hearings in a downtown LA courtroom a stone's throw from where Murray was convicted in 2011.

After a full morning on the stand Friday, she resumed testifying after lunch, but appeared confused by questions and within five minutes the judge agreed to recess the case until Monday, when she will finish her testimony.

Emotional Katherine Jackson addresses jurors for first time

The matriarch of the Jackson family testifies in the wrongful-death case against AEG Live that she 'lost everything' when her son Michael died in 2009.

An emotional Katherine Jackson spoke to jurors about her pop star son for the first time Friday, smiling as she described the way he danced as a baby and later weeping as she recalled his death, saying she "lost everything."

The 83-year-old matriarch held attorney Brian Panish's hand as she walked to the stand, one of the most anticipated witnesses in the wrongful-death case between her family and entertainment giant AEG Live over Michael Jackson's death.

Jackson and three of her grandchildren — Prince, Paris and Blanket — are suing the company, alleging AEG Live negligently hired and controlled the physician who gave the singer a fatal dose of the anesthetic propofol as he was preparing for his "This Is It" comeback tour in 2009. AEG contends it was Michael Jackson who hired Dr. Conrad Murray.

Jackson has watched much of the months-long trial from the downtown L.A. courtroom's front row, and said she has struggled to remain composed as she listened to testimony about her seventh child.

"My son was sick and nobody tried to help him," she told AEG Live attorney Marvin Putnam. "I want to know the truth of what happened to him."

The civil trial has cast a harsh spotlight on some of the most private details of Michael Jackson's life — his erratic behavior, his drug use, his dramatic weight loss and his overwhelming fear of failure. Katherine Jackson defended her son against AEG executives, who called Jackson "lazy" and "the freak" in emails.

"The most difficult thing is to sit here in this court and listen to all the bad things they say about my son," Jackson said, later adding: "A lot of the things that have been said here are not the truth. And he's not here to speak for himself."

When Panish asked how she had been affected by her son's death, Katherine Jackson broke down.

"When a mother loses a child," she said, crying. "No one knows until it happens to them. That's the worst thing that could happen to a person, losing a child.

"I lost my mother, my father and my sister … but when I lost Michael, I lost everything," she said.

Jackson described Michael as a shy, sensitive person who cared deeply for others and loved music from the time he was a baby. She and her husband, Joe, raised nine children in a four-room home in Gary, Ind.

"When all the kids were dancing around, he was in my arms and he couldn't be still. He was dancing to the music," she said. "And when he started to walk, he would still dance."

Though her son always sang around the house, Jackson said, it wasn't until 5-year-old Michael sang "Climb Ev'ry Mountain" at a school program that she realized just how talented he was.

When Michael was about 6, she said, he joined his older brothers in singing competitions at local high schools — losing only once because people "were sick of seeing the Jacksons win." The boys wore suits made by their mother and rehearsed at home, pushing the living room furniture back to the walls and dancing in the middle of the floor.

The Jackson 5's fame grew, and the brothers signed a record deal with Motown in 1968. But it was his solo career that catapulted Michael Jackson to stardom.

Katherine Jackson smiled as she described her son's generosity, saying he provided for her financially and the two were always "very close." She said he even named the train at his Neverland Ranch "Katherine."

Jackson, a Jehovah's witness, said she was doing "field service" — going door to door to share her faith — and returned home to a message from her husband the day their son died. One of the fans camped outside their son's home had called Joe Jackson, saying someone had left on a gurney "completely covered up," she testified.

When she got to the hospital, she said, she found her son's staff and a man she later learned was Murray "pacing back and forth." It was the singer's manager who finally broke the news, she said.

"I just started screaming," she said.

Paris, now 15, was especially distraught, her grandmother said. "She was screaming, looking up at the sky and said, 'Daddy, I want to go with you,'" Katherine Jackson recalled. "'I can't live without you. I'm going with you.'"

In the days after her son's death, Jackson said she went with Paris to find a "broken heart" necklace. The girl went to the morgue, "hung one heart around her father's neck" and kept the other half, her grandmother said.

Jackson now shares guardianship of the three children. Paris has "had the hardest time" coping with her father's death, she said, acknowledging the teen has received medical help and been hospitalized.

Katherine Jackson watched as a video was played for jurors, showing footage of her grandchildren set to a recording of her son singing "Speechless." He wrote the song about being a father, she said.

"Mrs. Jackson, do you miss your son?" Panish asked when the video ended.

"Words can't explain," she said.

Fans line up to see Katherine Jackson testify in AEG lawsuit

By Kate Mather
July 19, 2013, 10:05 a.m.

<iframe src="http://embed.newsinc.com/Single/iframe.html?WID=1&VID=24958782&freewheel=69016&sitesection=selatimes&width=600&height=400" height="400" width="600" scrolling="no" frameborder="0" marginwidth="0" marginheight="0"></iframe>

About a dozen fans of Michael Jackson gathered Friday outside the downtown Los Angeles courtroom where Katherine Jackson was set to testify in her family's wrongful-death lawsuit against AEG.

One wore a black T-shirt that read: "We support you Katherine."

Fans regularly attended the months-long trial, watching from an overflow room or one of the coveted public seats raffled off each morning. A short cheer broke out Friday for the woman who received a ticket allowing her inside the courtroom.

"Yay!" one of the other fans said. "I had a feeling."

Katherine Jackson and her the singer's three children -- Prince, Paris and Blanket -- filed a wrongful-death lawsuit against AEG Live, the company that was promoting the singer's ill-fated comeback tour. It would be her first court appearance in the case.

The suit claims the entertainment giant negligently hired and controlled the physician who gave the singer a fatal dose of the anesthetic propofol in 2009, days before his "This Is It" tour was to open in London.

AEG says it was Michael Jackson who hired Dr. Conrad Murray, and that any money the company was supposed to pay the doctor was an advance to the singer.

Murray is serving jail time for his involuntary manslaughter conviction.

Other Jackson family members have already testified in the trial, which began more than two months ago and could continue through October.

Michael Jackson's eldest son, Prince, took the stand in late June, when the 16-year-old testified about his childhood, his father's preparations for the "This Is It" tour, and the day the singer died.

Two of Michael Jackson's nephews have also testified, including TJ Jackson, who with his grandmother shares guardianship over the King of Pop's children.

Katherine Jackson has spent much of the trial seated in the front row of the courtroom, where she has been well-received by her son's fans who also routinely watch the proceedings.
