Oscar Pistorius, das Model, der Valentinstag und das war dann Notwehr
19.03.2014 um 21:57Während @Tussinelda grübelt, noch das:
Proof of premeditated murder:
Four witnesses hearing RS screaming before gunshots.
OP did not call ambulance or police.
Security guard called OP and testified OP said everything is fine.
OP affidavit shows claim he was walked from exit door of bedroom, got gun, down hallway, towards alleged danger, shot 4 times.
OP's allegation he feared imminent harm requires OP to prove that, not for the state to disprove it.
It would be like James Holmes claiming as a defense in the Colorado movie shootings that he was working for the CIA and part of the MK Ultra project and then expecting the state be required to prove he wasn't. That's obviously not how criminal trials work.
The state has presented a prima facie case. OP killed RS. Witnesses confirmed what OP admitted. Four witnesses testified to hearing RS scream immediately before hearing gunshots. All evidence affirmed this.
What's not reasonable is OP's explanations:
It's not reasonable to believe all four witnesses misheard the exact same thing, and that what they heard was OP replicating the sounds of the murder he just committed.
It's not reasonable to be sharing a bedroom with somebody, hear somebody in the toilet, and NOT think it might be the person you're sharing the room with until after shooting four times into the toilet.
The burden of proof is now on OP to explain how his admitted killing of RS actually is NOT a violation of SA criminal code. This is why OP, like Jodi Arias did, must testify. He has no choice.
